Community Development Director Frolik explained the way the ordinance is written no one
would be grandfathered in, although she has not discussed this stipulation with the City Attorney
yet.

City Attorney Goodrich advised the ordinance can state there is not a grandfather clause. It can
be determined what occurs from the inclusion of this clause.

Mayor Gamec inquired about clear zones.

Community Development Frotik replied MnDOT would look at that. They pass it on to the
who determines if the airspace is safe enough to operate the aircraft. MnDOT takes that into
consideration when they decide if they will issue a license. Usually i£the FAA does not feel it is
safe it will not be licensed.

Councilmember Zimmerman asked if this ordinance is modeled after another city.

Community Development Director Frolik replied she started with the bare bones minimum
saying there will be no aircraft operation at all and got to this point.

Councilmember Kurak clarified the City does not need to grant a conditional use permit. She
noted even if someone owns ten acres, an aircraft could disturb a lot of people in the area.'

Mayor Gamec requested staff finish the drafting of this ordinance as soon as possible.

MAYOR AND COUNCIL

None.

ADJOURNMENT

Motion by Councilmember Elvig, seconded by Councilmember Pearson, to adjourn the meeting.

Motion can'ied.

The City Council Work Session of the City Council adjourned at 6:58 p.m.

Respectfully submitted,

Carol Hamer
Recording Secretary
TimeSaver Off Site Secretarial, ]nc.

James E.
