Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 7:04 p.m. <br /> <br />Presentation <br /> <br />Con2nunity Development Director Frolik stated that Ramdance LLC is proposing to develop <br />Outlot I of Ramsey Town Center. The first phase of the development wilt include a 54,000 <br />square foot grocery store and an I8,000 square foot retail building. Community Development <br />Director Frolik stated the subject property is zoned TC-2 Town Center Commercial and Section <br />9.20.25 (3) (b) of City Code establishes a minimum front yard setback of 0 feet and a maximum <br />front yard setback of 15 feet. She indicated the Town Center Development Guidelines for the <br />TC-2 Sub-District encourages large scale retail to locate adjacent to the Burlington Northern <br />Santa Fe railroad corridor. Community Development Director Frotik advised that any attempt to <br />locate the front of the grocery store within 30 feet of the street right-of-way would result in the <br />loading dock areas being located in the midst of the public parking, area. As a result, placement <br />of the store adjacent to the railroad results in a front yard setback of approximately 300 feet. <br /> <br />Community Development Director Frolik noted that the sketch plan for the development of the <br />grocery store was approved by the Planning Commission on May 6 and by the City Council on <br />May 11, 2004, and showed the grocery store being located adjacent to the railroad along the <br />south property line. Conwnunity Development Director Frolik advised Staff recommends <br />approval of the variance. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />Motion by Chairperson N~xt, seconded by Board Member Johnson, to close the public hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Board Members Jolmson, Brauer, Shepherd, <br />and Watson. Voting No: None. Absent: Board Members Jeffrey and Van Scoy. <br /> <br />The public, hearing closed at 7:05 p.m. <br /> <br />Board Business <br /> <br />Chairperson Nixt called the Board of Adjustment meeting back to order at 7:05 p.m. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Shepherd, to adopt Resolution <br />#04-07-174 adopting Findings of Fact//0683 in favor of the request from Ramdance LLC for a <br />variance to maximum fi'ont yard setbacks for the proposed grocery store to be constructed in the <br />TC-2 Sub-District of the Ramsey Town Center. <br /> <br />-58- <br /> <br />Board of Adjustment/July 12, 2004 <br /> Page 2 of 3 <br /> <br /> <br />
