It was discussed in the minutes of the last <br />meeting held regarding these amendments. <br /> <br />City Attorney Goodrich indicated the Master Development A~eement states the assessment <br />must be paid off at the time of sale. <br /> <br />Councihnember Elvig stated the Master Development A~eement has a stipulation that the <br />master develop.er or secondary developer has to pay that assessment, and he does not see that the <br />Council has changed their position at all on this. The 22 acres is coming back as a special <br />assessnlent. <br /> <br />Coul~cih:aember Cook questioned when all the aspects of this Development A~eement <br />Amendment would be acted on. <br /> <br />Mr. Lasher replied the action of the Council tonight would only agee to the stipulation of the <br />transfer of $836,566.33 to RTC if they produce letters from PACT Schools and DR Ho~ton and a <br />promissory note fi'om the bmr. The benclm~arks and transfer of land would still require Council <br />approval. - <br /> <br />City Attorney Goodrich advised an assessment a~'eement will be needed from DR Horton and <br />PACT Schools, rather than only a letter of a~eement. <br /> <br />Councilmember Strommen stated she is struggling with assessing residential properties for <br />parking structures when those residents will have their own parking facilities at their homes. <br />This is a pedestrian community in desiN¥ and they would be charging the residents for a parking <br />stxn.~cture. A~yone outside of Town Center would be more likely to use the parking ramp than the <br />residential properties inside Town Center. <br /> <br />Councilmembei' Kurak commented when they first started Town Center the Council was <br />adamant that Town Center would pay for itself and they would not assess people outside of those <br />320 acres. If they are going to be able to assess and get the roadways in they will have to look at <br />assessing the residential properties in that s_0 acre parcel. <br /> <br />Councilmember Strommen indicated she is not suggesting people outside of Town Center should <br />be assessed, but slie does not understand that people inside Town Center would be assessed. She <br />understands the businesses being assessed, but not the residents. <br /> <br />Councilmember Elvig conn:nented they are not necessarily assessing the homeowners; they are <br />assessing the developer of'the properties. If the developer chooses to pass that along in the <br />market they may be able to raise the price of the house, or they may have to take it out of their <br />profits.
