CASE 3: CONDITIONAL USE PERMIT; CASE OF FAITH BAPTIST CHURCH: <br /> <br />The City Council will be guided by paragraphs 170.016A through <br />170.016F in the action they will be taking on this matter. <br /> <br />Problem: Faith Baptist Church has presented two alternatives <br />to the Planning and Zoning Commission at the public hearing <br />and they are as follows: <br /> <br />a) Construct a new church on same property and restore present <br /> church back to its original use as a home for the minister. <br />b) Reconstruct present church (former residential dwelling) <br /> only they would increase the size of it and chm~ge design <br /> v~ereby it would never probably be viewed as a dwelling. <br /> <br />Now, the citizens from what I gathered at the public hearing <br />are opposed to any of the above alternatives that. the church <br />presented at the public hearing. However, they would accept <br />the church be restored to its original design. (before ~e fire) <br />and use but not enlarged. <br /> <br />Staff Recommendation and Comments: City Council should review <br />the following paragraphs to the City's Zoning and Subdivision <br />Code over very carefully. <br /> <br />a) Paragraph 170.016D Standards for Consideration: This sets <br /> up the gUidelines whether or not the conditional use is to <br /> be allowed. <br />b) Paragraph 170.016E Criteria for Approval: This sets up the <br /> guidelines if a conditional use shall be approved if and <br /> only if it is found to meet all the criteria. <br />c) Please refer to enclosure (D2-a) for City Engineers report <br /> on soil boring test.' <br />d) Please refer to enclosure (D2-b) for City Attorney's finding <br /> of fact which he will cover further verbally. <br />e) Please refer to enclosure (D2-c) which covers the historical <br /> background on the subject matter. <br /> <br />Action Required: Please refer to enclosure D2-d (Planning and <br />Zoning Commission public hearing dated September 5, 1978). Fur- <br />ther refer to enclosure (B-2) this agenda action taken by Planning <br />and Zoning Commission to deny request. <br /> <br />CASE 4: FRANK FREEZE; REGARDING SIGN ORDINANCE: <br /> <br />He will be present to address the City Sign Ordinance. I have <br />not discussed it with him so I don't have his complaint on the <br />subject matter. <br /> <br />CASE 5: REPLACEMENT OF ENGINE FOR 1967 INTERNATIONAL TRUCK; <br /> <br />Please refer to enclosure (D2-e). Further, the Street Superinten- <br />dent will be present to address any questions you may have. <br /> <br /> <br />
