130.095 - F~tion of Appl[cationo If %he applica~/on is by a natural person, it shall be signed and s~xDrn ~o by such person; if by a collDorakion, by an officer thereof; if by a par~mership, by one of %he partners; if by an unincorporated associak/on, by %he m_~nager or m~naging officer f_hereof. If the applicant is a partnership, the applicaf~ion a~d any license, ]~nd or insurance policy shall be made and issued in the names of all %J~e partners. 130. 096 - Renewal Application. Applications for the renew-~l of an ey~isting license shall be ~r~de ah least sJ~ty (60) days prior to the date of the expiration of the license and shall be ~m~de'in such abbreviated form as ~ne city council may approve. If, in the j~n~_n% of the council, good and sufficient cause is shown by any applicant for fa~ l~e to file for a ~ne~al within the time provided, the council may, if the other provisions of t~is section are~complied with, waive ~his requirement and grant the appli- 130.097 - t.]c~mnse Fe~s. Upon rejeckion of any. application for a license, or ~upon withdrawal of application before approval of the issuance by the city council, the license fee shall be refunded to ~he applicant. 4. The fee for an "off-sale" and "on-sale" wine license granted after the connence- n~t of the license year shall be pro-raked on a m~nthly basis. /~" 5. The oouncil may in its judgment refund a pro rata portion of f_he fee for %he unexpired period of the license, computed on a monthly basis, when operation of the licensed business c~mes not less than one (1) month before expiration of the license because of: a. Destruct/on or damage of the licensed premises by fi_re or ott~ catastrophe; b. A change in the legal status of the municipality making it un]awful for a Licensed business ko continue; c. The death of the licensee, managing partner, or managing officer of' licensee. -4-
