TO: Mayor and Council FROM: City Administrator RE: Council Old Business Enclosure (2-a) Planning and Zoning Commission minutes dated December 11, 1978 (2-b) Section 170.0144 of the City Code (2-c) Section of City Code entitled Building Design and Con- struction CASE ~1: APPOINTMENT OF NEW COUNCIL MEMBER TO FILL THE UNEXPIRED TERM OF CASE #2: ROBERT MULLER VACATED COUNCIL POSITION: Council members received a packet containing the applicants who filed for this vacated position. Further, please refer to your Council agenda dated February 12, 1979 (D-3 case #7) which covers the law in filling a vacated council position. ' GROSSLEIN PROPOSED BUILDING: Background: The Planning Commission (Please see enclosure D2-a) reviewed the Grosslein request at their meeting dated December 11, 1978. However, due to the required variances needed they referred it on to the Board of Adjustment without taking any action in accordance with Section 170.0144 of the City Code, (Please refer to enclosure D2-b) until the aforemention action had been taken. However, the Council at their meeting of March 12, 1979, (Please refer to enclosure A-1 page 4 this agenda) passed a motion stating the Council would do a site plan review of this project. Inasmuch as our ordinance really only provides for a screening review of a project of this nature by the Planning Commission only (Please refer to enclosure D2-b), I assume your motion really meant to accomplish this screening task because of your familiarity of the case. Site plan review gets~into a whole new bucket of worms and your ordinance doesn't provide for it. You did at your last meeting direct the Planning Commission to prepare an ordinance for site plan review. However, presently your City code provides for only as shown in enclosures (D2-b and D2-c). Please refer to the Grosslein plan which is attached to this agenda for youm review and action. Council Action: Will be in accordance with enclosures (D2-b and ~2-c),
