Community Development Director Frolik stated that the TC-2 regulations can be amended to be <br />fairly restrictive with respect to accessory gas operations. <br /> <br />Commissioner Johnson noted that the proposed ordinance contains a typographical error in <br />Section l(b) and should read "5. Gas operations shall constitute n__0_o more than three pumping <br />islands." [addition of the word "no"] <br /> <br />Motion by Commissioner Johnson, seconded by Chairperson Nixt, to recommend to the City <br />Council adoption of amendment to the TC-2 Zoning District to allow for accessory gas uses as <br />drafted by City Staff and modified by the Planning Commission, including further definition of <br />the term "accessory." <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Brauer, Shepherd, and <br />Watson. Voting No: None. Absent: Commissioners Jeffrey and Van Scoy. <br /> <br />Case #5: <br /> <br />Public Hearing - Request for a Conditional Use Permit to Construct a <br />Building Larger than 35,000 Square Feet in the TC-2 Zoning District; Case <br />of Ramdance; LLC <br /> <br />Chairperson Nixt closed the regular portion of the Planning Commission meeting at 7:51 p.m. in <br />order to call the public hearing to order. <br /> <br />Public Hearing <br /> <br />Chairperson Nixt called the public hearing to order at 7:51 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik stated that the City received an application from <br />Ramdance LLC for a site plan to construct a 54,000 square-foot grocery store in the Ramsey <br />Town Center. She explained the TC-2 District requires a Conditional Use Permit (CUP) for <br />buildings larger than 35,000 square feet and the applicant has submitted an application for a CUP <br />in order to construct the grocery store. <br /> <br />Community Development Director Frolik advised the TC-2 Zoning District was created to <br />accommodate larger scale, auto-orientated commercial activities. However, due to certain aspects <br />associated with larger scale retail buildings (i.e. aesthetics, traffic circulation), the TC-2 District <br />states those buildings larger than 35,000 square feet are required to receive a CUP. <br /> <br />Community Development Director Frolik stated City Staff recommends approval of the <br />Conditional 'Use Permit to allow for a building larger than 35,000 square feet in the TC-2 Zoning <br />District. <br /> <br />Citizen Input <br /> <br />Planning Commission/July 12, 2004 <br /> Page 7 of 15 <br /> <br /> <br />
