Commissioner Van Scoy introduced the following resolution and moved for its adoption: <br />RESOLUTION #16-12-226 <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO THE FRONT <br />YARD SETBACK FOR AN EXISTING HOME AND PROPOSED DECK ON THE <br />PROPERTY LOCATED AT 14950 PERIDOT ST NW, OTHERWISE KNOWN AS LOT 6, <br />BLOCK 5, PINEVIEW ESTATES, AND DECLARING TERMS OF SAME. <br />WHEREAS, Tara Wostrel and Justin Linder (Permittee), have properly applied for a <br />variance (the "Variance") from the City of Ramsey (the "City") to the front yard setback in the R- <br />1 Residential (Rural Developing) District on the property generally known as 14950 Peridot St <br />NW and legally described as follows: <br />Lot 6, Block 5, Pineview Estates, Anoka County, Minnesota <br />(the "Subject Property"); and <br />WHEREAS, the Planning Commission met on December 1, 2016, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance to the front yard setback <br />requirements for an existing home and proposed deck on the Subject Property. <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br />1. Based on Findings of Fact #0974, a Variance to the front yard setback for an existing home <br />as well as the construction of a new deck within the required front yard setback area on the <br />Subject Property is hereby granted. <br />2. That the dwelling and deck on the Subject Property shall maintain a minimum front yard <br />setback of twenty-five (25) feet from the public road right-of-way. <br />3. No construction shall commence without first obtaining a Building Permit from the City. <br />4. That this Variance shall automatically expire if the use is not initiated by December 1, <br />2017 and issuance of a Building Permit for the deck shall constitute initiation. <br />5. The Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br />The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br />Nosan, and upon vote being taken thereon, the following voted in favor thereof: <br />Chairperson Bauer <br />Commissioner Van Scoy <br />Commissioner Nosan <br />
