TO: Mayor and City Council FROM: City Administrator SUBJ: Informational Critique on Vera McGregor request for variance on lot size in commercial zoning transitional area and [Sherwin Schenk i request for variance on lot size in commercial zoning transitional area ' Enclosure (D4-a) Planning and Zoning minutes dated April 2, 1979 (D4-b) City Engineer's report dated March 29, 1979 (D4-c) Sumvey of metes and bounds subdivision of land CASE #1: VERA McGREGOR REQUEST FOR LOT SIZE VARIANCE IN COMMERCIAL ZONING IN TRANSITIONAL AREA: Background Information: Vera McGregor wants to subdivide the parcel of land (location: where her restaurant is located) of five (5) acres (MOL) into three parcels which would be less than the two and one-half acres which is the requirements for commercial zoning in the transitional area. She wants to subdivide land so she can locate her off-sale store on one of the parcels. She has been before the Planning Commission for sketch plan re- view. The following is submitted for your information and review on this request: a) Enclosure (D4-a) contains Planning and Zoning minutes dated April 2, 1979, where they advised her to' go to the Board of Adjust- ment to get lot size variance. They also recommended she proceed to preliminary plan providing she got this variance. b) Enclosure (D4-b) contains the City Engineer's letter dated March 29, 1979, which contained his comments. Comments: The Commercfal and Industrial lot size is currently before the Planning Commission for lot size review in regards to platting. Council directed that the Planning Commission submit recommendation to them on proposed lot sizes for platting in stated zoning districts. However, the Planning and Zoning Commi-". ssion due to work load have not been able to give this a review and submit their recommendations. Council has authorized a variance to Gateway North Industrial Plat #2 in lot sizes of one acre from the required two and one- half acres.
