8. Section 170.038F Dedication of Parks and Open Spaces <br /> <br />Amend Section 31-19 to read as follows: <br /> <br />Pursuant to Minnesota Statutes, lg71, Section 462.348, Subdivision 2 <br />as amended in Chapter 176 Minnesota Laws, 1973~ the City Council <br />of the City of Ra~eyshall require all developers requesting plat- <br />ting or replatting or the development of unplatted land in' the City of <br />Kamsey to contribute lands, in the amounts listed below, to be <br />dedicated to the public for their use as either parks, playground, <br />public open space, trail systems, water ponding, public lands or to <br />contribute an equivalent amount of cash, based upon the conditions out- <br />lined below. The form of contribution (cash or land, or any combination <br />of) shall be decided by the City Council based upon need and conformance <br />with approved City plans. ' <br /> <br />(b) <br /> <br /> Ail monies collected from cash contributions shall be placed in a special <br /> fund from which only those public uses, as liste& in {a) above may be <br /> constructed or improved, or.land for those same uses maybe acquired. <br />· Cash contributions shall be based upon current assessors' fait market <br /> value on the undeveloped land. <br /> <br />(4) <br /> <br />~ere a proposed park, playground or other recreational areas, pro- <br />posed school site or other public ground that has been indicated in the <br />official map and/or master plan is located in whole or in part within a <br />proposed subdivision such proposed public site shall be designated as <br />such and should be dedicated to the City, School District or other proper <br />governmental unit. If the subdivider chooses not to dedicate an area in <br />excess of the land required-under.this.Section hereof fo~ such proposed <br />public site, the Council shall not be required to act to approve or <br />disapprove the plat of the subdivision for a period of ninety (90) days <br />'after the subdivider meets all the provisions of the subdivision Title <br />in order to permit the Council,.School Board or other appropriate <br />governmental unit to Consider the proposed plat andto take.the necessary <br />steps to acquire, through purchase~or condemnation all or part of the <br />public site proposed under the official map or master plan. <br /> <br />In such cases where the developer is required to dedicate land area, <br />the City Commission of the City of R~nsey, shall have the tight to <br />determine the geographic location and configuration of said dedication. <br /> <br /> <br />
