TO: City Administrator <br /> <br />FROM: City Attorney <br /> <br />RE: UMB-2 Zoning <br /> <br />U~-2 allows all permitted uses of the UMB district except eating establish- <br />ments and drive in banking facilities. The UMB district, pursuant to the <br />zoning chapter is to be a "periphery zone" between the R and UB zones. The <br />UMB-2 district is to be further restrictive in that eating places and drive <br />in banks are to be excluded. A review of the nfinutes indicate that the <br />Council intended the UMB-2 district to be one which permitted uses that would <br />not "generate a lot of traffic". The Council was also concerned that the <br />laneowner be permitted to sell his property without City involvement thus a <br />zoning district instead of non-conforming use was necessary and therefore, <br />the UMB-2 zone for non-conforming uses was established. <br /> <br />OhM ay 29, 1979, the Council found that Mr. Aydt's Auto Body business would <br />have "no adverse impact in the area in accordance with the review process <br />of Section 170.015F" and therefore, permitted the auto body business to be <br />expanded and this expansion should be viewed as a non-conforming use expansion <br />only. <br /> <br />Because there is no conditional use or non-conforming use restrictions, Mr. <br />Aydt's present business could be sold and converted to just about any use <br />which is similar to an auto body use and the City would have little to say <br />about this. <br /> <br />It would ~eem that the bottom line question to be answered by the Council <br />is what uses do you want permitted in this area? UB uses, UMB or residential <br />or some other use combination? You should also provide specific uses you <br />want permitted and what specific uses you want excluded. This is particularly <br />important because the subject property is surrounded by residential property. <br /> <br />WG:sb <br /> <br /> <br />
