-2- <br /> <br /> II. <br /> <br /> After the execution of this Contract by the parties of said <br />Contract, and after all other requirements for a building permit have <br />been satisfied by the Developer, the City shall issue a permit to the <br />Developer for the construction of the proposed Development. <br /> <br /> III. <br /> <br /> Landscaping shall be designed to compliment landscaping of <br />other property in the area of the real estate to be developed, and shall <br />screen the real estate to be developed from the real estate in the <br />area, as shown on Exhibit "A" as required by the City Zoning Ordinance <br />and the City Council. Screening shall consist of a grass area 40 feet <br />wide to the rear of the business (the R-1 zoned area which is to be <br /> <br />leased property). The following trees or bushes shall be planted: <br /> TYPE <br /> SIZE <br /> QUANTITY <br /> <br /> IV. <br /> <br />As required by Section 170.014H(5) of the City Code, the <br />Developer shall provide the City with a performance bond or cash escrow <br /> <br />in the amount of $.~ to insure that the provisions of the <br /> screen- <br /> <br />ing and landscaping requirements are complied with. The above amount <br />represents 150% of the City Engineer's estimated cost of the improvements. <br />The bond or escrow shall run to the City of P~m~ey and be in force for a <br />period of two (2) full growing seasons following installation of the land- <br />scape plantings. <br /> <br /> <br />
