2 <br /> <br />might be subject .ooding depending on thei~pecified locations. <br />The Interim Regulations prohibit the placement of on-site disposal <br />systems in the floodplain and require a setback of'75 feet from <br />the normal high water mark. The plan is inconsistent with this <br />requirement and does not~ recognize the potential problem of floqding <br />or indicate' solutions to this hazard. 'The applicant does,not indi- <br />cate whether the' development will meet local or statewide floodplain <br />regulations or the requirements for on-site sanitary systems. <br /> <br />Also, the applicant's plan does not indicate how Critical Area <br />requirements for grading and filling to minimize erosion and water <br />pollution ~i~l be met. <br /> <br />Based on the information provided by 'the applicant the Metropolitan <br />Council concludes that the proposed development is inconsistent With <br />the Critical Area Interim Development Regulations in the following <br />ways and should be denied. <br /> <br /> 1. The proposed lot.sizes are inconsistent with'.the fivc--acre <br /> minimum lot size forunsewered areas. <br /> <br />o <br /> <br />The proposed development is inconsistent with the objectives <br />and purposes of the Rural Open Space district. <br /> <br />3.~ The.proposed subdivision of lots and placement of on-site ~ <br /> .,'~i.sanitary systems is inconsistent with the prohibition of <br /> ~ such systems within the floodplain and the placement of <br /> structures,.in the.floodplain. ~ <br /> <br />It should be pointed out that under the Critical Area planning <br />standards the city is to distinguish between those areas to be <br />servedby public sewer and by on-site disposal systems. This is <br />to be coordinated with the preparation of the city's comprehensive <br />plan under the Land Planning Act. ~Development in areas not to be <br />provided with municipal and metropolitan sewers should be in con- <br />formance with on-site disposal system regulations recommended in <br />the Council's Water Quality Management Plan. Land use patterns <br />outside the Metropolitan Urban Service should be consistent with <br />the polici~s~of the Council'slDevelopment Framework to ensure that <br />there will be no need for the premature provision of urban and <br />metropolitan services. Local Critical Area plan policies should <br />reflect the Rural Open Space district requirements and metropolitan <br />policies. Local units of ~government may recommend modifications of <br />the use district boundaries if that change.would be consistent with <br />the Critical Area planning requirements. <br /> <br /> Sincerely, <br /> <br /> Charles R.
