However, <br />since the EQB has no real zoning authority I can Only comment on the proposed <br />zoning as it may affect the general use guidelineS for the Rural Open Space <br />District and the Critical Area in general. The most pertinent guidelines are: <br /> <br /> "'"' 1. Rural Open Space District.. The lands and waters within this district <br /> shall be used and developed to prese~rVe their.open, scenic and natural <br /> characteristics and ecological and economic .functions. 'Presently <br /> undeveloped islands shall be maintained in their existing natural <br /> state. The transportation function of the river shall be ma. intained <br /> and preserved. : <br /> <br /> 2. The Mississippi River Corridor §hall be managed in accordance. with <br /> the Metropolitan Council's Development Guide Chapter, Critical Areas <br /> Act of 1973, and the Minnesota Environmental Policy Act of 1973, <br /> and other-applicable state laws, and federal laws. <br /> <br /> It is also difficult for t~e EQB staff to c~mment on a zoning change since <br />the primary purpose of the Critical Area's Planning Process is for local govern- <br />ment to reassess their existing plans and regulations against the. designation <br />order. I would assume that your plan_ner is a~alyzing existing zoning and is <br />recommending appropriate modifica.tions. Since your planner 'is more familiar · <br />with the community and Other ~factors influencing.local~ zoning, I would recom- <br />mend you solicit his comments and review the 'proposed zon~hg amendments against <br />your.draft Critical Area Plan. <br /> <br /> I have:'reviewed the zoning amendment requests against'the Critical Area" <br />Planning Standards and Guidelines and the Interim Development Regulations'.
