NOW THEREFORE, for and in consideration of the mutual <br />agreements and covenents and conditions hereinafter contained, <br /> <br /> IT IS HEREBY AGREED AS FOLLOWS: <br /> <br /> The Developer agrees to submit the required building <br /> <br />permit and site plan and other data required to obtain a building <br />permit by the City of Ramsey. <br /> <br /> II. <br /> <br /> The Developer agrees to construct the residence in <br /> <br />accordance with the State Building Code and all Ramsey codes and <br />ordinances. <br /> <br /> III. <br /> <br /> The Developer shall execute a quit claim deed conveying to the <br />City of Ramsey a permanent easement over and across a strip of land <br />seven (7) feefi wide, said seven (7) foot strip being adjacent to the <br />existing southerly right of way of 167th Avenue. <br /> <br /> The Developer will execute a quit claim deed conveying a permanent: <br />easement to the City over and across the easterly 66 feet of the west <br />274.28 feet of the Developers tract of land as shown on the attached <br />exhibit A - the specific leg4Ll description for ~id basement shall be <br />as shown on the final plat of the subject property. <br /> <br /> That the residence to be constructed shall use the easement <br /> <br />above described in paragraph IV,. as its access onto 167th Avenue N.W. <br /> <br />and the existing residence located on the Developer's property shall <br /> <br />-2- <br /> <br /> <br />
