Administrator Schnelle cautioned that P & Z Commissioners should <br />really 8efine what they want in the agreement so the City and <br />Mr. Aydt do not end up spending money in attorney fees if at some <br />time ~n the future a unpleasant situation should arise. <br /> <br />Chairman Peterson stated that if Mr. Aydt did ever sell his <br />business that he would like to have the potential buyer appear <br />before the Commission before the purchase to review the conditional <br />use with the buyer. <br /> <br />Review of the proposed conditional use agreement: <br /> <br />No. 1 and 2 - stay the same as proposed. <br />No. 3 - The permittee shall be able to sell occasional cars <br />and trucks with a maximum of three on display at one time on the <br />easterly side of the property. <br /> <br />No. 4 - 6utside storage of auto parts shall ~ visually screened <br />with something compatible with 'the area. <br /> <br />No. 5 - A fenced in storage lot for damaged and towed in autos. <br />and trucks comprising an area of 20,000 square feet with a six <br />foot high fence to adequately screen the storage lot. <br /> <br />No. 6 - No salvage yard or junk yard activities to be carried <br />on at anytime. (The intent is to prohibit solicitation and sales <br />of auto parts). <br /> <br />No. 7 - Prior to the sale of the business, the ~onditi~onal use <br />permit is subject to review upon change of ownership ~and/or <br />operation and upon violation of the above Agreements. <br /> <br />Discussion held regarding No. 5 - Chairman Peterson had <br />suggested the area be only 10,000 square feet but Mr. Aydt <br />wanted a larger area in case~he wanted to include fencing in <br />his shop area. Art Dunn stated that he did not see any reason <br />to put a size on it until he ~knew for sure just where the fence <br />would be installed. It was consensus of the Commission to have <br />Mr. Aydt indicate on a site plan map drawing of the acre shop <br />area where the fenced area would be situated and that he could <br />have a maximum of 20,000 square feet of fenced in storage yard. <br />Ron West said he would go along with a cha,in link fence but that <br />it would be a maintenance problem, he could have colored slats <br />or wooden slats and that in the long run the wooden slats would <br />be less expensive due to less maintenance. <br /> <br />Motion by Art Dunn and seconded by Ben Deemer to recommend that <br />the City Council grant the conditional use agreement to Mr o Aydt <br />as proposed with the above changes. <br /> <br />Motion carried. 5 - 0. <br /> <br />P & Z Regular Meeting <br /> 11/5/79 <br /> Page 4 <br /> <br /> <br />
