Control Rules. Regulations and Air Quality Standard designated <br />APC Regulation 1-15 inclusive, adopted by the Minnesota Pollution <br />Control Agency on May 11, 1969, filed with the Secretary of State <br />on July 3, 1969, and the Department of Administration on July <br />7, 196~ together with the 1970 Supplement filed with the Secretary <br />of State and Department of Administration on June 5, 1970', and all <br />rules, regulations and standards amendatory thereof or supplementary <br />thereto are hereby adopted for the purpose of establishing the <br />rules, regulations and air quality standards governing the emission <br />of dust, dirt, smoke, odor and noxious gases from an Industrial <br />District Use: and all of said rules, regulations and air quality <br />standards are hereby referred to, adopted, incorporated by reference <br />and made a part hereof as though fully set forth in this ordinance. <br /> <br />GLARE: <br /> a) Glare, whether direct or reflected, shall not be visible <br /> beyond the limits of the sites of the' permitted use. <br /> <br />WASTES: <br /> a) Ail solid waste material and refuse shall be stored within a <br /> completely enclosed structure or contained in a closed container <br /> designed for such purpose. All liquid wastes containing any or- <br /> ganic or toxic matter prescribed by the city engineer. The city <br /> engineer shall prescribe the manner of sewage treatment and disposal in <br /> the case of large-volume water useage. Reference Ordinance Septic <br /> System Zoning 150.01 and 170.038H <br /> <br />COMPLIANCE: <br /> a) In order to assure Compliance With the performance standards <br /> set forth above, the City Council may require the' owner or operator <br /> of any permitted use to make such investigations and tests as may <br /> be required to show adherence to above performance standards. <br /> Such investigation and tests as are required to be made shall be <br /> carried out by an independent testing organization as may be <br /> agreed upon by the City and the owner or operator, or if there is <br /> failure to .agree within ten (10) days after written notice by the <br /> City to the owner or operator of the requirement to make such <br /> investigation and tests, by such independent testing organization <br /> as may be selected by the Council. The costs incurred in having <br /> such investigations or tests conducted shall be born entirely by <br /> the owner or operator. The procedure stated above shall not pre- <br /> clude the City from aking any such other tests and investigations it <br /> finds appropriate to determine compliance with these performance <br /> standards. <br /> <br />CONDITIONAL USES <br /> Conditional Uses are governed by 170.016 "'CONDITIONAL USES" of this <br />chapter of the City Code ' <br /> <br />VARIANCE <br /> Variances are governed by 170.018 "BOARD OF ADJUSTMENT AND VARIANCES" <br />of this chapter of the City Code. <br /> <br />Addendum to site plan and building design approval <br /> <br />If Applicant does not commence construction of his project, <br />including physical facilities, within t~l~e~(-~) months following <br />approval of this agreement, the City Council approval shall be <br />considered null and void for the entire project unless an extension <br />is granted by the City Council. <br /> <br /> <br />
