Control Rules. Regulations and Air Quality Standard designated APC Regulation 1-15 inclusive, adopted by the Minnesota Pollution Control Agency on May 11, 1969, filed with the Secretary of State on July 3, 1969, and the Department of Administration on July 7, 196~ together with the 1970 Supplement filed with the Secretary of State and Department of Administration on June 5, 1970', and all rules, regulations and standards amendatory thereof or supplementary thereto are hereby adopted for the purpose of establishing the rules, regulations and air quality standards governing the emission of dust, dirt, smoke, odor and noxious gases from an Industrial District Use: and all of said rules, regulations and air quality standards are hereby referred to, adopted, incorporated by reference and made a part hereof as though fully set forth in this ordinance. GLARE: a) Glare, whether direct or reflected, shall not be visible beyond the limits of the sites of the' permitted use. WASTES: a) Ail solid waste material and refuse shall be stored within a completely enclosed structure or contained in a closed container designed for such purpose. All liquid wastes containing any or- ganic or toxic matter prescribed by the city engineer. The city engineer shall prescribe the manner of sewage treatment and disposal in the case of large-volume water useage. Reference Ordinance Septic System Zoning 150.01 and 170.038H COMPLIANCE: a) In order to assure Compliance With the performance standards set forth above, the City Council may require the' owner or operator of any permitted use to make such investigations and tests as may be required to show adherence to above performance standards. Such investigation and tests as are required to be made shall be carried out by an independent testing organization as may be agreed upon by the City and the owner or operator, or if there is failure to .agree within ten (10) days after written notice by the City to the owner or operator of the requirement to make such investigation and tests, by such independent testing organization as may be selected by the Council. The costs incurred in having such investigations or tests conducted shall be born entirely by the owner or operator. The procedure stated above shall not pre- clude the City from aking any such other tests and investigations it finds appropriate to determine compliance with these performance standards. CONDITIONAL USES Conditional Uses are governed by 170.016 "'CONDITIONAL USES" of this chapter of the City Code ' VARIANCE Variances are governed by 170.018 "BOARD OF ADJUSTMENT AND VARIANCES" of this chapter of the City Code. Addendum to site plan and building design approval If Applicant does not commence construction of his project, including physical facilities, within t~l~e~(-~) months following approval of this agreement, the City Council approval shall be considered null and void for the entire project unless an extension is granted by the City Council.
