Motion by Councilman Reimann and seconded by Councilman Cox <br />to readvertise for an off-sale intoxicating liquor license <br />for 30 days from today to take applications, the deadline set <br />for accepting applications will be December 21, 1979. <br /> <br />Motion carried. Voting yes: . Mayor Gamec, Councilmen Cox, <br />Mickelson, Reimann and Sorteberg. Voting no: None. <br /> <br />Councilman Reimann noted that those persons who paid the <br />investigation fee previously and had the investigation would <br />have to update the information if necessary but would not <br />necessarily have to pay the fee again if there are no changes <br />in their status. <br /> <br />CONDITIONAL USE PERMIT; CASE OF BILE AYDT <br /> <br />Discussion held regarding the intent of Council regarding <br />Mr. Aydt. And that it was intended that Mr..Aydt be allowed <br />to operate his auto body repair business as it was when.the <br />zoning was designated and that he would be able to sell' the <br />business at a later date if he so desire, so his investment <br />could be protected since he was "grandfathered"under the zoning. <br /> <br />Councilman Cox commented that ~he thought the reason Bill <br />was seeking a conditional use permit at this time is that <br />he wanted to expand his existing business. <br /> <br />Councilman Mickelson expressed his concern that the City may <br />be too restrictive, that if they are looking for business <br />to establish in the City, the restrictions should not be <br />created to make it undesirable for them to locate here. <br /> <br />Mayor Gamec asked if the Council wofild rather rezone it to <br />UB instead of the conditional use permit agreement. <br /> <br />Council.man Cox expressed concern that the intention of the <br />grandfathering in of the business was to see that it would <br />be viable and profitable as an auto body business and that <br />it would remain marketable as such if Mr. Aydt so desires <br />at some future time. <br /> <br />The screening of cars was discussed and Mr. Aydt indicated <br />that all vehicles would be stored in the fenced in area <br />except those on sale. <br /> <br />Discussion held on cars that would be on display for sale. <br /> <br />Consensus of the Council is that they would go along with <br />Mr. Aydt having a maximum of three cars for sale on display <br />on his premises. <br /> <br />Motion by Councilman Mickelson and seconded by Councilman Cox <br />to enter into the Conditional.
