<br /> <br />11.That the B-2 Highway Business District specifies that exterior wall finishes shall consist of <br />face brick, stucco, glass, natural stone, specifically designed pre-cast concrete units whose <br />surfaces have been integrally treated with an applied decorative material or texture, factory <br />fabricated panel materials if the panel material is to be of the aforementioned finishes, or other <br />materials as approved by the Planning Commission and City Council. <br /> <br /> <br />12.That past practice of the City has been to consider membrane type structures as a violation of <br />City Code based on the exterior finish material. <br /> <br /> <br /> <br />13.That temporary structures are still subject to the provisions of the International Fire Code and <br />Minnesota Building Code. <br /> <br /> <br />14.That a Temporary Tent/Canopy Permit is required to erect this Structure. <br /> <br /> <br />15.That the proposed duration of the Structure (approximately 120 days) exceeds that of a <br />Transient Merchant as defined in City Code Section 26-549 (maximum of sixty \[60\] days). <br /> <br /> <br />16.That the City’s Strategic Plan includes a Strategic Initiative to improve the image of key <br />corridors, including Highway 10, and that the proposed use appears to conflict with this <br />initiative, unless relocated to the rear of the building. <br /> <br /> <br />17.That interim use permits are temporary in nature and must be aligned with a specific ending <br />date or event. <br /> <br /> <br />18.That the Applicant has stated that the Structure would be needed through May 14, 2017 (the <br />weekend of fishing opener). <br /> <br /> <br />19.That the proposed use does conform to the zoning regulations within the B-2 Highway <br />Business District. <br /> <br /> <br />20.That the date or event that will terminate the use can be identified with certainty. <br /> <br /> <br />21.That permission of the use will not impose additional costs to the public if it is necessary for <br />the public to take the property in the future. <br /> <br /> <br />22.That the proposed use will not adversely impact traffic in the area. <br /> <br /> <br />23.That the proposed use will not be dangerous or detrimental to persons residing or working in <br />the vicinity of the use or to the public welfare. <br /> <br /> <br />24.That the proposed use will not substantially or adversely impair the use, enjoyment or market <br />value of surrounding properties. <br /> <br />RESOLUTION #17-01-008 <br />Page 3 of 5 <br /> <br />
