Councilmember LeTourneau introduced the following resolution and moved for its adoption: <br /> RESOLUTION #16-11-229 <br /> RESOLUTION APPROVING AN AMENDED EASEMENT ENCROACHMENT <br /> AGREEMENT FOR A PYLON SIGN TO BE INSTALLED IN A DRAINAGE AND <br /> UTILITY EASEMENT ON LOT 1, BLOCK 1 COR TWO NORTHSTAR AND <br /> DECLARING TERMS OF SAME <br /> WHEREAS, Northstar Marketplace Station LLC, hereinafter referred to as the <br /> "Applicant,"has requested an Amended Encroachment Agreement to install a new pylon sign(the <br /> "Sign") in place of the existing monument sign within drainage and utility easements (the <br /> "Easements") on the property legally described as follows: <br /> Lots 1, Block 1, COR Two Northstar <br /> (the "Subject Property"). <br /> WHEREAS,the Applicant has applied for a permanent sign permit to install one (1) Sign <br /> that is seventy-five (75) feet in height and 334 square feet in size on the Subject Property; and <br /> WHEREAS, the Engineering Department has found that the Easements can still function <br /> with the encroachment of the Sign; and <br /> WHEREAS, City Council reviewed the request on November 22, 2016. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> 1. That, contingent upon the Applicant entering into an Amended Easement Encroachment <br /> Agreement with the City and recording said agreement against the Subject Property, the <br /> Applicant may install, maintain and repair the Sign in accordance with the terms and conditions <br /> contained within the Amended Easement Encroachment Agreement. <br /> The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> Shryock, and upon vote being taken thereon, the following voted in favor thereof: <br /> Mayor Strommen <br /> Councilmember LeTourneau <br /> Councilmember Shryock <br /> Councilmember Johns <br /> Councilmember Kuzma <br /> Councilmember Riley <br /> Councilmember Williams <br />
