Councilmember LeTourneau introduced the following resolution and moved for its adoption: RESOLUTION #16-11-229 RESOLUTION APPROVING AN AMENDED EASEMENT ENCROACHMENT AGREEMENT FOR A PYLON SIGN TO BE INSTALLED IN A DRAINAGE AND UTILITY EASEMENT ON LOT 1, BLOCK 1 COR TWO NORTHSTAR AND DECLARING TERMS OF SAME WHEREAS, Northstar Marketplace Station LLC, hereinafter referred to as the "Applicant,"has requested an Amended Encroachment Agreement to install a new pylon sign(the "Sign") in place of the existing monument sign within drainage and utility easements (the "Easements") on the property legally described as follows: Lots 1, Block 1, COR Two Northstar (the "Subject Property"). WHEREAS,the Applicant has applied for a permanent sign permit to install one (1) Sign that is seventy-five (75) feet in height and 334 square feet in size on the Subject Property; and WHEREAS, the Engineering Department has found that the Easements can still function with the encroachment of the Sign; and WHEREAS, City Council reviewed the request on November 22, 2016. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That, contingent upon the Applicant entering into an Amended Easement Encroachment Agreement with the City and recording said agreement against the Subject Property, the Applicant may install, maintain and repair the Sign in accordance with the terms and conditions contained within the Amended Easement Encroachment Agreement. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Shryock, and upon vote being taken thereon, the following voted in favor thereof: Mayor Strommen Councilmember LeTourneau Councilmember Shryock Councilmember Johns Councilmember Kuzma Councilmember Riley Councilmember Williams
