PUBLIC HEARING <br /> <br />CASE # } <br /> <br />PUBLIC HEARING TO VACATE A PORTION OF A DRAINAGE AND UTILITY EASEMENT <br />ON LOT 2, BLOCK 1, HAUSER ADDITION (WISER CHOICE LIQUOR); <br /> CASE OF M & W HOLDING LLC <br /> By: Patrick Trudgeon, AICP Assistant Community Development Director <br /> <br />Background: <br /> <br />Lot 2, Block 1, Hauser Addition currently has standard drainage and utility easements around the <br />perimeter of the lot. The parcel is located at 14590 Armstrong Blvd. and presently occupied by Wiser <br />Choice Liquor Store. M&W Holding LLC is requesting site plan approval for an expansion of the liquor <br />store that would encroach in the drainage and utility easement along the southern property line. The <br />applicant has asked that the drainage and utility easement along the southern property line be vacated in <br />order to allow for the expansion. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site Location Map <br />b) Exhibit of underlying easements to be vacated <br />c) Proposed ordinance <br /> <br />Public Notice: The public hearing was properly notified in the Anoka County Union as required under <br />State Statute. <br /> <br />Observations: <br /> <br />The subject property was zoned B-3 Highway Business when it was originally constructed. The site is <br />now zoned TC-2 Town Center Commercial which allows for zero-lot line setbacks. <br /> <br />The applicant is proposing to expand their building to within eight inches of the southern lot line. This <br />expansion will contain additional cooler space and display area. Since there is a standard 10-foot <br />drainage and utility easement along the southern lot line, the easement will need to be vacated to allow <br />for the expansion. There are no utilities located in the present easement and drainage will be reviewed as <br />part of the site plan approval. <br /> <br />Recommendation: <br /> <br />Staff recommends that the City Council conduct the public hearing and introduce the attached ordinance <br />vacating the drainage and utility easement along the southern property line of Lot 2, Block 2, Hauser <br />Addition. <br /> <br />Council Action: <br /> <br />Motion to introduce Ordinance #04-08 to vacate the drainage and utility easement along the southern <br />lot line of Lot 2, Block 1, Hauser Addition. <br /> <br />Review Checklist: <br />Asst.
