with the Park and Recreation Commission regarding appropriate terms to satisfy park dedication <br />requirements. <br /> <br />The Park and Recreation Commission met in April to discuss the minor subdivision. The Park <br />Commission desires to provide park land and preserve-open space along Trott Brook when <br />opportunities arise. The Commission recommended park dedication be satisfied through a <br />combination of a cash payment and dedication of land. The Commission instructed staff and the <br />applicant to work together to determine an appropriate size and location for the park. Staff and <br />Eliot agreed to the following: 1.01 acre land dedication, cash payment of $1,034, and a private <br />easement to be drafted and recorded by the Applicant to allow for appropriate ingress and egress <br />from the park land to Outlot A (Eliot will maintain ownership of Outlot A). The terms are clearly <br />set forth in the attached Development Agreement. <br /> <br />Upon completion of the lot survey by Hakanson Anderson, it became apparent that Mr. <br />Schaffer's detached garage is located a few feet on his neighbor's property. In order to correct the <br />situation, both Mr. Schaffer and his neighbor applied for an ~dministrative Subdivision, which <br />will allow Mr. Schaffer to purchase a portion of his neighbor's property. Staff approved the <br />Administrative Subdivision and now the applicant is responsible for recording the appropriate <br />documentation at Anoka County. Approval of the final plat will conform to the approved <br />Administrative Subdivision. <br /> <br />The City approved a 90~day moratorium affecting the subdivision .of lots within the rural <br />developing district that became effective in July. The subject property is included in the recently <br />adopted moratorium. However, due to the fact that the Planning Commission approved the <br />sketch plan in March and staff and the applicant continued to work on the plat to resolve park <br />dedication terms, it seems appropriate to continue with approval of the final plat. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the final plat contingent upon the applicant entering into a <br />Development Agreement with the City. <br /> <br />Council Action: <br /> <br />Motion to approve the final plat for Falconer's Ridge contingent upon the City and the Applicant <br />entering into a Development Agreement. <br /> <br />-or- <br /> <br />Motion to deny the proposed final plat. <br /> <br />Review Checklist: <br />Community Development Director <br /> <br />CC: 8.24.04 <br /> <br /> Copies To: <br />Public Works Director/Fire Chief <br />Engineering <br /> <br /> <br />
