The re- <br />quest was tabled for more information from the City Attorney and City <br />Administrator on this matter. I have consulted with the City Attorney <br />on the subject variance. He feels each ase should be handled on an in- <br />dividual basis. <br /> <br />Recommendation: In view of the contents contained in references (a) <br />and (b), I'm of the opinion that only the City Council should act on <br />Mr. Werz's request for variance from reference (a). However, inasmuch, <br />as the Planning and Zoning Commission has heard Mr. Werz plea, you may <br />want to make your recommendation to the City Council on this matter. <br />If that is your desire to submit a recommendation to the Council <br />approving/disapproving, it should be done in accordance with the pro- <br />vision of reference (c). <br /> <br />CASE 2: ACCEPTANCE OF STREET; CASE OF MAGNESIUM STREET <br /> <br />Please refer to enclosure (1) of this memo for Engineer's report on the <br />above subject street. <br /> <br /> <br />
