(e) City Zoning & Subdivision Code paragraph 170.035A (in its entirety) (1) Engineers report on Magnesium Street (2) Engineers report on sketch plan for T.W.Anderson proposed dental clinic (3) Zoning Administrator report regarding sketch plan for proposed dental clinic VARIANCE FROM SUBDIVISION ORDINANCE; CASE OF ALEX WERZ: Background: Mr. Werz purchased a one acre lot (located at 16960 Bison Street N.W.) in August, 1972 with the understanding it was a buildable lot in accordance with the City Code at time of purchase. Now, the Planning and Zoning Commission at their meeting of August 8, 1978, heard Mr. Werz plea for a variance from reference (a). The re- quest was tabled for more information from the City Attorney and City Administrator on this matter. I have consulted with the City Attorney on the subject variance. He feels each ase should be handled on an in- dividual basis. Recommendation: In view of the contents contained in references (a) and (b), I'm of the opinion that only the City Council should act on Mr. Werz's request for variance from reference (a). However, inasmuch, as the Planning and Zoning Commission has heard Mr. Werz plea, you may want to make your recommendation to the City Council on this matter. If that is your desire to submit a recommendation to the Council approving/disapproving, it should be done in accordance with the pro- vision of reference (c). CASE 2: ACCEPTANCE OF STREET; CASE OF MAGNESIUM STREET Please refer to enclosure (1) of this memo for Engineer's report on the above subject street.
