Voting yes Councilman Gamec, Councilman Mickelson, Council- <br />man Reimann, Councilman Muller and Mayor Cox. Voting no None. <br /> <br />Mayor Cox feels the City is being forced in a legal bind and will cost the <br />City a lot of money. <br /> <br />Mr. Nielson asked what does the City expect? <br /> <br />Mayor Cox responded by-stating they adhere to the law. <br /> <br />Councilman Gamec feels it is the developers own responsibility to come' and . <br />ask for an extension of time.--:.Healso ,feels~there.have~been so many changes <br />from the original plat of HighPoint... <br /> <br />Motion carried., Voting yes Councilman Gamec,~'CouncilmanMicketson,..Council- <br />man Reimann,:.Councilman.Muller and MaYor:-,coX~.-, Voting~no~None;~ <br /> <br />DEVELOPMENT CONTRACT. FOR 'HIGH.~OINT. , <br /> <br />Mr. Holker is requesting an extra year on the development contract for High <br />Point. <br /> <br />Motion by Councilman Gamec to accept Mr. Holker-'s request-for a completion <br />date of October 31, 1980. in the:performance ~contract_.with~an:_additional.:. <br />amount added of ~$ 7; S00 '~to~ either :~the~ perfomance,-bond .Or~.,cash:~escrow ,, <br />deposit. <br /> <br />Motion dies for lack of second.: <br /> <br />Motion by CouncilmanReimann and seconded by Councilman Mickelson to accept <br />a performance contract with Mr. Tom Holker with a completion date of <br />October 31, 1979 and the estimated cost of improvement to be $50,150 and <br />the either performance bond or cash escrow deposit amount be $75,225. <br /> <br />Motion carried. Voting yes Councilman Mickelson, Councilman Reimann, <br />Councilman Muller and Mayor Cox. Voting no Councilman Gamec. <br /> <br />Motion by Councilman Muller and seconded by Councilman Mickelson to accept <br />the performance contract and letter of credit as requested at the November 13, <br />1978 meeting in regards to a building permit request entailing the entire <br />40 acres of High Point. <br /> <br />Motion carried. Voting yes Councilman Mickelson, Councilman Reimann, Council- <br />man Muller and Mayor Cox. Voting no Councilman Gamec. <br /> <br /> <br />
