REQUEST FOR; CASE OF PHILLIP KERSSEN

Background: The following data is submitted for your infor-
mational purposes:

a) Enclosure (1) application for rezoning dated July 7, 1978
b) Enclosure (2) Planning Commission minutes dated August 7,
1978
c) Enclosure ~3) Council minutes dated August 28, 1978

Originally, Mr. Kerssen applied for rezoning as stated in en-
closure (1). However, when Mr, Kerssen appeared before the
Planning Commission as covered in enclosure (2) you granted him
a conditional use permit for reason stated therein, Your
recommendation as contained in enclosure (2) went to the City
Council and they revised your action as covered in enclosure
(3) in that they stated he should have his property rezoned to
UMB. It was pointed out to the Council at that time by City
Staff that rezoning would not alleviate Mr. Kerssen's problem.
However, they felt UMB zoning would be more compatible'with
Mr. Kerssen's requested use,
