Councilmember <br /> <br />intrOduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION # 04-09- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO <br />MICHAEL METTLER TO EXCEED THE MAXIMUM SQUARE FOOTAGE ALLOWED <br />FOR ACCESSORY STRUCTURES BASED ON FINDINGS OF FACT # AND <br />DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, Michael Mettler (Permittee) has properly applied for a Conditional Use Permit <br />to exceed the maximum square footage allowed for accessory buildings for properties between 1 <br />and 1.99 acres as established in section 9.11.02 (Accessory Uses) of City Code on the property <br />generally ka~own as 15315 Sunfish Lake Blvd NW and legally described as follows: <br /> <br />The south 194.5 feet of that part'of the SoUthwest Quarter of the Northwest Quarter of <br />Section 23, Township 32, Range 25, Anoka County,, Minnesota lying easterly of the <br />centerline of'County State Aid Highway Number 57._ Excluding road and subject to <br />easements of record. <br /> <br />(Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on September 2, 2004, conducted the <br />public hearing and recommended City Council approval of the request; <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY <br />OF IL~kMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as folloWs: <br /> <br />Based on Findings of Fact # , a Conditional Use Permit (Permit) to exceed the maximum <br />allowable square footage for accessory building space on properties between 1 and 1.99 acres in <br />size is hereby granted to Michael Mettler, hereinafter referred to as the "Permittee". <br /> <br />That the overall square footage for accessory buildings may exceed the 1,664 square foot <br />accessory building size restriction for properties between 1 and 1.99 acres by a total of 264 <br />square feet in order to accon'u'nodate the inside storage of private-use equipment and vehicles. <br /> <br />3. That the construction of the addition on the detached accessory building on the Subject Property <br /> shall require issuance of a building permit from the City of Ramsey. <br /> <br />4. That the accessory building shall be properly constructed and maintained in accordance with all <br /> applicable International Building Codes. <br /> <br />5. The Permittee herein a,~rees, that no business use will be operated in the detached, accessory . <br /> building unless such use is permitted in accordance with the City Code. <br /> <br />Thc Permittee herein agrees to allow Staff to inspect the site within thirty (30) days of the final <br />inspection of the addition to verify that off-street parking and condition of premises violations <br />have been resolved. <br /> <br />7. That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br />11 <br /> <br /> <br />
