PUBLIC HEARING
REQUEST FOR COMPREHENSIVE PLAN AMENDMENT;
CASE OF ARTHUR AND ELIZABETH RAUDIO
By: Sylvia Frolik, Community Development Director

CASE #

Background:

,~rd
The Future Land Use Map of the 2001 Comprehensive Plan identifies Outlot E, River's Bend .~
Addition as Medium Density Residential. Since at least the mid -1980's, this vacant parcel was
zoned commercial. Upon a recent inquiry from the owners, Arthur and Elizabeth Raudio,
regarding a potential buyer and development of the parcel with a commercial use, it was
discovered that the parcel had been rezoned to medium density residential.

The following items are enclosed for your information:

a) Site location map
b) Proposed Resolution approving the request and authorizing submittal to Metropolitan
Council

Notification:

State law requires that property owners within 350 feet of the subject property be notified of the
public hearing.

Observations:

At lvlr. Raudio's request, Staff did some research as to when the property was actually rezoned
f?om commercial to medium density residential. The last time there was official action on the
property was in 1993 when a portion of River's Bend 3rtl Addition was rezoned from commercial
to single family residential. At that time, the zoning on Outlot E was not changed and remained
as commercial. Staff fbund a zoning map from 1998 in which the property was shown as
medium density residential, it is staff's belief that somewhere along the line an error occurred
and the subject parcel was colored as medium density residential on the CiW's zoning map. It
would have been difficult to recognize the error as the two vacant parcels north of Mr. Raudio's
parcel are also zoned medium density residential.

Even though it appears that the parcel's current designation started as a technical error on the
zoning map, it was shown as Medium Density Residential in the 2001 Comprehensive Plan
adopted by the City Council. Because of this, the applicant must apply for a Comprehensive Plan
Amendment and Rezoning.

2O
