Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION//04-09- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # TO REZONE CERTAIN <br />PROPERTY FROM R-2 MEDIUM DENSITY RESIDENTIAL TO B-1 BUSINESS <br /> <br /> WHEREAS, on August __, 2004, the City received an application to rezone certain <br />property in accordance with Section 9.03.03 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That Arthur and Elizabeth Raudio, hereinafter referred to as "Applicants," have properly <br /> applied to rezone certain property from R-2 Medium Density Residential to B-1 Business. <br /> <br />That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br />the City Code on September 2, 2004 and said public hearing was properly advertised, and <br />the minutes of said public hearing are hereby incorporated by reference. <br /> <br />3. That the property proposed to be rezoned is legally described as follows: <br /> <br />Outlot E, River's Bend 3~d Addition, Anoka County, Minnesota. <br /> <br />4. That the area of the property to be rezoned is approximately 1.5 acres in size. <br /> <br />5. Prior to adoption of the 2001 Comprehensive Plan and subsequent re-zoning, the Subject <br /> Property was zoned for commercial uses. <br /> <br />6. That the Subject Property is currently zoned R-2 Medium Density Residential and is <br /> located within the boundaries of the current Metropolitan Urban Service Area (lvfUSA). <br /> <br />7. That the Comprehensive Plan designates the property for Medium Density Residential <br /> development. <br /> <br />That City Staff has determined that the property has historically been zoned for <br />commercial uses and apparently during a time frame between 1993 and 1998, there was <br />an inadvertent error on the City zoning map that was carried through into'the 2001 <br />Comprehensive Plan that officially rezoned the property to medium density residential. <br /> <br />9. That the Applicant has submitted a Comprehensive Plan Amendment to change the land <br /> use designation in the Comprehensive Plan back to Places to Shop. <br /> <br />10. That the proposed zoning amendment will/will not substantially adTversely impair the use <br /> or market value of any surrounding property. <br /> <br /> <br />
