Chairperson <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br /> RESOLUTION #04-09- <br /> <br />RESOLUTION APPROVING THE ISsuANCE OF A VARIANCE 'TO CONSTRUCT A <br />FOUR SEASON PORCH ADDITION WITHIN THE SETBACK FROM THE <br />ORDINARY HIGH WATER MARK OF THE MISSISSIPPI RIVER AND DECLARING <br />TERMS OF SAME <br /> <br /> WHEILEAS, Sheldon and Melinda Mayer (Permit-tee) have properly applied for a <br />variance fi'om Section 9.21.07 of the Ramsey City Code to construct a four-season porch addition <br />within the dstablished setback of the Ordinary High Water mark of the Mississippi River on the <br />property generally known as 9124 Collins Dr. NW and legally described as follows: <br /> <br />Lot 11, Block 2, Itasca Heights, Anoka County, Mi~mesota <br /> <br />(Subject Property). <br /> <br /> AND WHEREAS, the Board of Adjustment conducted a public hearing on September 2, <br />2004, pursuant to Section 9.03.05 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF 1L4MSEY, ANOKA COUNTY, STATE OF MINNESOTA, as followS: <br /> <br />That based on Findings of Fact #~., a variance to construct a four-season porch within the <br />setback from the Ordinary High Water mark of the Mississippi River on the Subject Property <br />is hereby granted. <br /> <br />That the tbur-season porch addition constructed on the Subject Property shall maintain a <br />minimum setback of eighty-five (85) feet f¥om the Ordinary High Water mark and thirty-five <br />(35) feet fi'om the bluffline. <br /> <br />3. That the exterior finish of the proposed addition shall match that of the principal structure, <br /> including soffit, fascia, and eave overhang. <br /> <br />4. That the Permittee shall be responsible for all costs incurred in administering and enforcing <br /> this variance. <br /> <br />5. That the Permittee shall obtain all necessary permits prior to commencing any construction of <br /> the ['bur-season porch addition. <br /> <br />6. That this Variance shall automatically expire if the use is not initiated by September 2, 2005 <br /> and issuance of the building permit shall constitute initiation. <br /> <br />The motion ~br the adoption of the foregoing resolution was duly seconded by Board Member · and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />13 <br /> <br /> <br />
