Chairperson introduced the following resolution and moved for its adoption: RESOLUTION #04-09- A RESOLUTION DENYING THE ISSUANCE OF A VARIANCE TO SHELDON AND MELINDA MAYER AT 9124 COLLINS DRIVE NW (PERMITTEES) TO CONSTRUCT A FOUR-SEASON PORCH ADDITION WITHIN THE ESTABLISHED SETBACK FROM THE ORDINARY HIGH WATER MARK OF THE MISSISSIPPI RIVERAND DECLARING TERMS OF SAME WHEREAS, Sheldon and Melinda Mayer (Permittees) have Properly applied for a variance from Section 9.21.07 of the Ramsey City Code to construct a four-season porch addition within the established setback from the Ordinary High Water mark of the Mississippi River on the property generally known as 9124 Collins Drive NW and legally described as follows: Lot i 1, Block 2, [tasca Heights, Anoka County, Minnesota (Subject Property). AND WHEREAS, the Board of Adjustment conducted a public hearing on September 2, 2004 pursuant to Section 9.03.05 of the Ramsey City Code. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That based on Findings of Fact # a variance to construct a four-season porch addition within the established setback from the Ordinary High Water mark of the Mississippi River on the Subject Property is hereby denied. The ~notion for the adoption of the tbregoing resolution was duly seconded by Board Member , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the £bllowing abstained: and the fi)llowing were absent: whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this the 2''l day or' September, 2004.
