CASE <br /> <br /> PUBLIC HEARING <br />REQUEST FOR A VARIANCE TO EXPAND A LAWFUL NONCONFORMING <br />ACCESSORY STRUCTURE THAT IS NEARER THE FRONT PROPERTY LINE <br />THAN THE HOME; CASE OF MICHAEL METTLER <br /> By: Chris Anderson, Community Development Assistant <br /> <br />Background: <br /> <br />The City has received an application for a variance to Sections 9.03.14 (Non-conforming <br />Structures and Uses) and 9.11.02 (Accessory Structures) of the Ramsey City Code. The <br />Applicant is proposing to construct an addition to a lawful, nonconforming, detached accessory <br />structure, which is nearer the front property line than the home, the location of which would <br />enable him to preserve mature oak trees on the property. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site layout <br />c) Site picture <br />d) Cross Section and Elevations of Proposed Addition <br />e) Letter from the Applicant <br /> Proposed Findings of Fact <br />g) Proposed resolution to approve variance <br />h) Proposed resolution to deny variance <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sent out notices to all property owners within 350 feet. <br /> <br />Observations: <br /> <br />City Code states that for properties less than two (2) acres in size, accessory structures must be <br />located in either the side or rear yard of the property and may not be located nearer the front <br />property line than the home. The subject property is approximately 1.73 acres in size and <br />currently has a lawful nonconforming detached garage that is closer to the front property line <br />than the home. Mr. Met-tier would like to expand this detached garage to provide additional <br />indoor storage of personal vehicles and equipment. The side and rear yard of this property are <br />heavily wooded and provide screening from the new town home development to the east (Alpine <br />Acres). <br /> <br />The subject property is approximately 400 feet in length and the home is setback fi'om the front <br />property line almost 300 feet.
