Motion by Chairperson Nixt, seconded by Board Member Brauer, to continue the public hearing <br />fbr the variance request of Kelly and Came Hemp to the September 3, 2004 Board of <br />Adjustment meeting. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Board Members Brauer, Jeffrey, Watson and <br />Van Scoy. Voting No: None. Absent: Board Members Johnson and Shepherd. <br /> <br />Case #3: <br /> <br />Request for a Variance to Floor Area Ratio Requirements in the TC-2 <br />Commercial Zoning District; Case of Ramdance,' LLC <br /> <br />Presentation <br /> <br />Assistant Community Development Director Trudgeon explained Ramdance LLC is proposing to <br />develop Outlot I of Ramsey Town Center. The property is located in the TC-2 Commercial <br />Zoning District which requires a Floor Area Ratio (F.A.R.) .of0.50. Lot 1 is only. showing.a <br />F.A.R.. of 0.24. The Planning Commission and CitY Council reviewed'the site plans for most-of <br />the buildings contained on Lot 1 and have approved the preliminary site plan contingent on <br />Ramdance receiving this variance, as well as receiving a variance to allow for more than one <br />principal building on a lot. <br /> <br />Assistant Community Development Director Trudgeon indicated the subject'property is zoned <br />TC-2 Town Center Commercial. Section 9.20.25 (3) (b) of City Code establishes a l'ninimum <br />Floor Area Ratio (F.A.R.) of 0.50. The F.A.R. was included in the TC-2 Commercial Zoning <br />District to require a certain amount ofbt~ilding coverage in the Town Center in order to <br />maximize development. The Town Center Development Guidelines for the TC-2 Commercial <br />Zoning District encourages large-scale retail. Given the need for areas of parking as well as <br />stonnwater management regulations, a large percentage of the 10t in the TC-2 District will be <br />utilized for non-building uses. Staff will be exploring the possibility of lowering the F.A.R. <br />requirement in the TC-2 Commercial Zoning District. However, the Board of <br />Adjustment/Planning Commission indicated that they would prefer to process a variance at this <br />time for the present development and look at amending the F.A.R. requirement at a later date. <br />The sketch plan for the development of the ~ocery store that was approved by the Planning <br />Commission on May 6 and the City Council on May 11, 2004 showed the layout under <br />consideration. He advised staff recommends approval of the variance. <br /> <br />Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7:20 p.m. in <br />order to conduct the public hearing. <br /> <br />Public'Hearin~ <br /> <br />Chairperson Nixt called the public heating to order at 7:20 p.m. <br /> <br />Citizen Input <br /> <br />Gregg Voss of Shingobee Builders stated he is present to answer questions.
