Discussion held. <br /> <br />Motion by Councilman Sorteberg, seconded by Councilman Mickelson to give <br />Mr. Deemer permission to enter into the development contract with the City <br />with the understanding that there will be no earth moving or work on <br />Nowthen Circle, 149th Lane N.W. and the lots abutting it, excepting Lot <br />21, Block 4, and Lot 5, Block 3. <br /> <br />Motion carried. Voting yes: Acting Mayor Reimann, Councilmen Mickelson <br />and Sorteberg. Voting no: None. <br /> <br />Mr. 'Jim Baunau, 167th and Dolomite Street~ stated he woiuld like to relocate <br />his driveway onto 157th Avenue. <br /> <br />Acting Mayor Reimann said there is limited access on a thoroughfare road and <br />167th Avenue is a thoroughfare road. <br /> <br />Mr. Baunau said he wants to appeal this matter. <br /> <br />He was instructed to have the City Engineer re'view his proposal and report <br />is to be submitted to the July 23rd Councilv~meeting. · <br /> <br />Mr. Lyle Daugherty, 15157 Yakima Street~ expressed concern regarding a <br />drainage problem he has that he feels will 'be aggravated now since the <br />street has been graded by the improvement project. .He is concerned about~ <br />a culvert being installed in his driveway to direct-the water away from his <br />property. He doesn't feel he should have to pay for the culvert since he <br />is the second owner of the property.. He feels this is an oversite on the <br />part of the building inspection department that they did not have the <br />builder or original owner install a culvert. <br /> <br />Councilman Mickelson said it was stated in the construction plans for the project <br />that any culverts that are needed would be installed at'the owner's expense. <br /> <br />Engineer Raatikka is to review this situation. <br /> <br />Acting Mayor Reimann said if the Engineer feels a culvert is needed, that <br />Mr. Daugherty will have to bear the expense of the purchase and installation <br />of the culvert. <br /> <br />Councilman Mickelson added that it has not yet been determined if a culvert <br />is needed. <br /> <br />Mr. Daugherty stated he doesn't feel he should have to pay for something that <br />is doing damage to his property and further, that he did not but it during <br />a rainstorm. <br /> <br />Acting Mayor Reimann informed Mr. Daugherty that if a culvert is necessary, <br />that he would be the one to benefit by it and further, tha~ the City has <br />never been in the practice of buying anyone's culverts, it has always been the <br />owner.!~ responsibility. <br /> <br />Regular Council Meeting <br /> June 25, 1979 <br /> Page 2 <br /> <br /> <br />
