Councilman Cox added that Berg Oil had decorated the front of their business <br />far more than expected and he has no problem with deleting the aggregate <br />from the accessory building. <br /> <br />Ron West indicated that he should have submitted reviewed plans to be a part <br />of his development contract and then this misunderstanding could have been <br />avoided. <br /> <br />Motion by Councilman Cox and seconded by Councilman Mickelson to refund <br />$76] .15 of the escrow amount to Ron West and eliminate the requirements <br />of the aggregate front from' the development contract. <br />The appropriate changes are to be made in the' contract and the minutes <br />to reflect the change. <br /> <br />MINNESOTA UTILITIES 'SITE PLAN FOR COUNCIL 'APPBOVAL <br /> <br />Lloyd Bearl of Minnesota Utilities' was present. -. <br />Administrator Schnelle explained the' problem that the Plafining and Zoning <br />Commission had with. this plan. <br /> <br />The parcel is landlocked. <br /> <br />Mayor Gm~ec said that this issue had been discussed when Ramsey 67 plat was <br />approved. Whenever the parcel in the rear is develOped then they and the <br />others would have to develop the road. Further, that befOre any further <br />development, the road would have to be Put in. He Said that Outlot B and <br />Lot 1 would be served by Tungsten Street', .That he' UnderStood that Outlot <br />B was to become Part of'Tract B and that there WoUld be no. building on <br />Outlot B until the Tungsten Street' is improved'. <br /> <br />Councilman Cox stated that this is an existing business that is being <br />added to and not another piece of property.. He did 'not see that what is <br />being proposed would have a great deal of affect on anything anymore than <br />what exists there already. <br /> <br />Councilman Mickelson added that the easement is presently being utilized as <br />access to this business. <br /> <br />Councilman Cox noted that the septic system as indicated on the site plan <br />was placed incorrectly. <br /> <br />Mr. Bearl said that it was in error and that it will be located to the north <br />on the Industry Avenue side of the property. <br /> <br />Motion by Councilman Cox and secOnded by Councilman Sor{eberg. to grant <br />a variance to Minnesota Utilities to use the' easement on th'e eaS't side of <br />the property as access to their business. <br /> <br />Motion carried. Voting yes: Mayor Gamec, Councilman Cox, Mickelson, Reimann <br />and Sorteberg.
