CC Regular Session 4. 10. <br />Meeting Date: 02/14/2017 <br />By: Chris Anderson, Community <br />Development <br />Information <br />Title <br />Adopt Resolution #17-02-043 Approving an Easement Encroachment Agreement for the Installation of a Ground <br />Sign for the Station; Case of DR Horton <br />Purpose/Background: <br />DR Horton (the "Applicant") has applied for a Permanent Sign Permit (the "Permit") for their current project <br />named the Station, located between Ramsey Parkway East, Rhinestone St, 146th Ave, and Peridot St. The <br />Applicant has proposed installing four (4) stone veneer columns connected with black aluminum powder coated <br />fencing (similar to wrought iron) at the southeast corner of the Subject Property on Lot 49, Block 1 Station (the <br />"Subject Property"). The lettering of the project sign will also consist of aluminum powder coated letters and would <br />be mounted on the aluminum fencing. The proposed location is within a public easement, necessitating this <br />proposed encroachment agreement. <br />Notification: <br />Notification is not required when considering an Easement Encroachment Agreement. <br />Observations/Alternatives: <br />The sign would be located within a drainage and utility easement on the Subject Property (all common areas on the <br />Subject Property are encumbered with drainage and utility easements). The proposed signage would be <br />approximately ten (10) feet inside the boundaries of the Subject Property. It appears to be in a location where there <br />is no storm sewer, sanitary sewer, or water main infrastructure and thus, it does not appear that it will impact any <br />utilities. The proposed sign location has been reviewed by the Engineering Department and no objections were <br />raised. <br />The sign itself appears to comply with the standards in The COR Design Framework in terms of height, square <br />footage, and materials. Also, per the plan sheets, will be located outside of the Vision Clearance Triangle as defined <br />in City Code. <br />Funding Source: <br />The cost for recording the Easement Encroachment Agreement against the Subject Property will be the <br />responsibility of the Applicant. <br />Recommendation: <br />Staff recommends adopting Resolution #17-02-043 approving the Easement Encroachment Agreement to allow the <br />installation of a project sign within a drainage and utility easement on Lot 49, Block 1 Station. <br />Action: <br />Motion to adopt Resolution #17-02-043 approving the Easement Encroachment Agreement to allow the installation <br />of a project sign within a drainage and utility easement on Lot 49, Block 1 Station. <br />Attachments <br />
