Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #17-02-043 RESOLUTION APPROVING AN ENCROACHMENT AGREEMENT FOR A PROJECT SIGN TO BE INSTALLED IN A DRAINAGE AND UTILITY EASEMENT LOT 49, BLOCK 1 STATION AND DECLARING TERMS OF SAME WHEREAS, The DR Horton, Inc., hereinafter referred to as the "Applicant," has requested an Encroachment Agreement to allow for the installation of a project sign (the "Sign") that would be located in a drainage and utility easement (the "Easement") on the property legally described as follows: Lot 49, Block 1, Station (the "Subject Property"). WHEREAS, the Applicant has applied for a permanent sign permit to the ten (10) square foot Sign on the Subject Property; and WHEREAS, the Engineering Department has found that the Easement can still function with the encroachment of the Sign; and WHEREAS, City Council reviewed the request on February 14, 2017. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That, contingent upon the Applicant entering into an Encroachment Agreement with the City and recording said agreement against the Subject Property and the Sign being located outside of the Vision Clearance Triangle as defined in City Code, the Applicant may install and maintain the Sign in accordance with the terms and conditions contained within the Encroachment Agreement. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: and the following abstained: and the following were absent: whereupon said resolution was declared duly adopted by the Ramsey City Council this the 14th day of February, 2017.
