While the appellate court had, <br />itself, previously held that oral approval of a zoning plan was suf- <br />ficient to commence the 30-day appeal period, the court found that <br />holding had been effectively overruled by the Supreme Court of <br />Pennsylvania. The Supreme Court had held that "all zoning decisions <br />are not final until a written decision is issued, and until a written deci- <br />sion is issued, there is no order to appeal." <br />See also: Narberth Borough v. Ct. 2016). <br />Zoning News from Around the <br />Nation <br />CONNECTICUT <br />A superior court judge has dismissed a lawsuit brought by the Con- <br />necticut Automotive Retailers Association against Tesla Motors Inc. <br />and the Planning and Zoning Board of Appeals of the Town of <br />Greenwich, CT. The suite alleged that the Town had allowed Tesla to <br />operate a showroom which allegedly violated zoning regulations. <br />Tesla had argued that the zoning approval was for an "educational <br />gallery to spread awareness about [electric vehicles] and its <br />technologies." <br />Source: The County Caller; www.thecountrycaller.com <br />NEW YORK <br />The New York City Council is considering "[a] package of 10 <br />zoning -related bills." Among those bills are ones that would: impose <br />a $25,000 fine on anyone "who makes a materially false statement or <br />causes a materially false statement to be made in connection with a <br />zoning application" (Int. 1392-2016); require the Board of Standards <br />and Appeals "to submit a written explanation of any decisions that are <br />made contrary to the local community board" (Int. 418-2014); require <br />the Board of Standards and Appeals to "establish rules for the <br />consideration of arguments and evidence submitted by parties, and to <br />refer to such arguments and evidence in final determinations" (Int. <br />282-2014); and propose that the Board of Standards and Appeals "cre- <br />ate an interactive online map of all variants and special permits ap- <br />proved by the agency since Jan. 1, 1996" (Int. 1394-2016). <br />Source: New York Press; www.nypress.com <br />© 2017 Thomson Reuters <br />11 <br />
