Councilmember Shryock introduced the following resolution and moved for its adoption: <br />RESOLUTION #17-02-043 <br />RESOLUTION APPROVING AN ENCROACHMENT AGREEMENT FOR A PROJECT <br />SIGN TO BE INSTALLED IN A DRAINAGE AND UTILITY EASEMENT LOT 49, <br />BLOCK 1 STATION AND DECLARING TERMS OF SAME <br />WHEREAS, The DR Horton, Inc., hereinafter referred to as the "Applicant," has requested <br />an Encroachment Agreement to allow for the installation of a project sign (the "Sign") that would <br />be located in a drainage and utility easement (the "Easement") on the property legally described <br />as follows: <br />Lot 49, Block 1, Station <br />(the "Subject Property"). <br />WHEREAS, the Applicant has applied for a permanent sign permit to the ten (10) square <br />foot Sign on the Subject Property; and <br />WHEREAS, the Engineering Department has found that the Easement can still function <br />with the encroachment of the Sign; and <br />WHEREAS, City Council reviewed the request on February 14, 2017. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That, contingent upon the Applicant entering into an Encroachment Agreement with the City <br />and recording said agreement against the Subject Property and the Sign being located outside <br />of the Vision Clearance Triangle as defined in City Code, the Applicant may install and <br />maintain the Sign in accordance with the terms and conditions contained within the <br />Encroachment Agreement. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />LeTourneau, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Strommen <br />Councilmember Shryock <br />Councilmember LeTourneau <br />Councilmember Johns <br />Councilmember Kuzma <br />Councilmember Riley <br />Councilmember Williams <br />
