The resJdept said the road has never been maintained by the city and now <br />he has to pay for the upgrading of it. <br /> <br />Mayor Gamec explained the city looked at it as a private driveway, but <br />a pe~nit should not have been issued without upgrading. <br />He told the resident that at the time of the assessment, a decision would be <br />made on whether he would be assessed or not. He said there could possibly <br />be two assessments on the two property owners there because they would benefit <br />more. <br /> <br />The resident noted that for eight years he had been paying taxes and did not <br />get any benefits and he asked if he would get his taxes back. <br /> <br />Mayor Gamec said no he wouldn't get his taxes back. <br /> <br />Councilman Cox asked the resident what he would prefer. <br /> <br />The resident said he wanted it blacktopped and he couldn't see that it is <br />benefiting him the same as the rest of the people. He asked if there was <br />going to be a cul-de-sac at the end of 177th s~ they can plow. <br /> <br />City Engineer Raatikka said the city is going to put a small turnamound there. <br /> <br />City Attorney Goodrich suggested hiring an~appraiser to go out there before <br />the project is begun. <br /> <br />Discussion was held .on hiring on appraisal of this project. <br /> <br />Councilman Cox noted that if the city proceeded with the whole project and <br />left out that area, the residents could come in down the line and demand the <br />city to take care of their street. <br /> <br />City Attorney Goodrich noted if there is a fire back there and the city can't <br />get to it, the city would be open to liability. This is a city-accepted street <br />and the city bas an obligation. <br /> <br />Councilman CoX said he saw water sitting in the road there and it appeared to <br />him something has to be done and he does see the responsibility on the city's <br />part. <br /> <br />Motion by Councilman Cox and seconded by CQuncilman Mickelson to adopt <br />Resolution #80- ~? Ordering Improvement an~ Preparation of Plans and <br />Specifications, Street Improvement Project (177th Avenue N.W., 178th Lane N.W., <br />179th Avenue N.W., Salish Circle, Tonto N.W., and Yakima Street N.W.) and <br />to hire an appraiser to review the properties before construction and see <br />what the benefits would be to the two property owners south of 179th & Yakima. <br /> <br />Motion carried. Voting yes-Mayor Gamec, Councilmen Sorteberg, Reimann, <br />Mickelson and Co~. Voting no-None. Please refer to resolution file for <br />Resolution ~80- ~7. <br /> <br /> Mayor Gamec told the resident that at the Assessment Hearing he would find <br /> out what his assessment would be and he could appeal it to District Coumt <br />· if he differed with what the council determined. <br /> <br />C/June 24, 1980 <br /> Page 6 <br /> <br /> <br />
