Councilman Cox said his past experience is that peop2 have been doing business
with this size building and his intentions were asked because of this.
Ne did not think'-.it is conducive to a residential area to have this large
a building.

Mayor Gamec said he agrred it is better to have his things inside a building,
but city staff cannot tell anyone whether a variance will be granted or not.
They can only tell the person that this is a route they can take.

Councilman Cox said a person should check a building of that size out before
they move into a neighborhood.

Mr. Tousley said city staff did not tell him there was an ordinance that
said 624 sq. ft.

Mayor Gamec said city staff did not know the council would deny his request
for a variance. They told him he could go over the 624 sq. ft. with a variance
if it is approved by the City Council. He said he would not approve an accessory
building over 624 sq. ft. on a one-acre lot.

Mr. Tousley said he got the findings of fact at the meeting that night, not
before the meeting. ~e felt he made a donation of $90 to the city.

City Administrator Schnelle said an accessory building could be sold to a person
to use it for a bnsiness.

Motion by Councilman Cox and seconded by Councilman Reimann to advertise for
a public hearing regarding applying for a building permit and entering into
contract stating that the building could not be used for operating a business.

Councilman Reimann said we already have an ordinance on these and be did
think the city should follow the ordinance it has.

City Administrator Schnelle said if the city has a standard agreement with
everyone that the building cannot be nsed as an operation of business,
it will be registered in their deeds.

Councilman Reimann suggested bringing out the ordinance when a person make
an application for an accessory.building and have them sign that they understand
it instead of making a contract with everybody.

Councilman Cox said that will take more boo~.keeping than the other would.

Councilman Sorteberg. said it won't hurt to hold a public hearing.

Motion denied. Voting yes-Councilmen Sorteberg and Cox. Voting no-Mayor
Gamec, Councilmen Mickelson and Reimann.

Motion by Councilman Cox and seconded by Councilman Reimann to follow the
ordinance as read rather than by complaint.

Councilman Reimann said it should be handled right by the letter.

Motion denied. Voting yes-Councilmen Cox and Reimann. Voting no-Mayor Gamec,
Councilmen Sorteberg and Mickelson.

C/June 24, 1980
Page 8
