Commissioner Nosan introduced the following resolution and moved for its adoption: <br />RESOLUTION #16-07-127 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0964 RELATING TO A REQUEST <br />FOR A VARIANCE TO THE FRONT YARD AND SIDE CORNER SETBACK IN THE <br />APPROVED PLAT OF WOODLANDS 3RD ADDITION. <br />WHEREAS, U.S. Home Corporation, dba Lennar, hereinafter referred to as "Applicant", <br />properly applied to the City of Ramsey (the "City") for a variance from the minimum front yard <br />and side corner setback length prescribed in Section 117-111, Subd. (d) of the property legally <br />described as follows: <br />Lots 6-12 (inclusive) Block 2, and Lots 1-14 (inclusive) Block 3, Woodlands 3rd <br />Addition, Anoka County, Minnesota <br />(the "Subject Property") <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY OF RAMSEY PLANNING, as <br />follows: <br />1) That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 117-53 (Variances) of the Ramsey City Code on July 7, 2016, and that said <br />public hearing was properly advertised, and that the minutes of said public hearing are <br />hereby incorporated as a part of these findings by reference. <br />2) That the Subject Property is zoned R-1 Residential (MUSA). <br />3) That the surrounding properties are also zoned R-1 Residential (MUSA). <br />4) That Section 117-111 Subd. (d)(3) of City Code requires a front yard and side corner <br />setback of thirty (30) feet. <br />5) That there are wetlands and stormwater ponds in the rear yards of the Subject Property <br />limiting the amount of usable/buildable space. <br />6) That a similar variance was approved for another subdivision in which all the yards backed <br />up to a stormwater pond. <br />7) That in May of 2016, the City adopted an ordinance amendment that established a <br />minimum lot depth standard to ensure more usable/buildable space in rear yards of newly <br />created lots (this new standard did not apply to the Subject Property). <br />8) That a reduced front yard setback should help limit the number of potential encroachment <br />issues and possible wetland fill violations on the Subject Property. <br />
