2) Duncan Johnson Re~arding Outlot "A" Carol Rose Acres <br /> <br />Mr. Johnson was present and submitted to the council soil-boring test results. <br />He said Art Dunn told him he didn't see why he couldn't build on Outlot "A". <br /> <br />City Administrator Schnelle said if that silts in the pond there, it could <br />be a problem. <br /> <br />Councilman Mickelson said that it looks like a drainage area. He said there <br />is no way he can put in a drain field. He would need about 5½' from the water <br />table. <br /> <br />Mr. Johnson said the pond has never gotten any bigger nor has there been <br />any free-standing water there at all in the three years he has been out there. <br /> <br />City Administrator Schnelle noted the city has had water problems on 164th. <br /> <br />Councilman Sorteberg questioned whether this could be made a buildable lot. <br /> <br />Councilman Cox said if a developer sold him a lot and misrepresented it, ~t <br />is not the council's responsibility, he said he was on the Town Board when <br />the plans were approved and it was approved with the outlot made for drainage. <br /> <br />Councilman Sorteberg said.he personally would not have a house there if <br />someone gave it to him because he would be afraid of water problems eventually. <br /> <br />Motion by Councilman Cox and seconded by Councilman Sorteberg to deny <br />Duncan Johnson's request to construct a house on Outlot "A" in Carol Rose <br />Acres in agreement with the Building Inspector report that the outlot is <br />unbuildable. <br /> <br />Motion carried. Voting yes-Mayor Gamec, Councilmen Sorteberg, Mickelson <br />and Cox. Voting no-None.- <br /> <br />Amend Section 110.143 of the City Code <br /> <br />City Attorney Goodrich said City Administrator Schnelle didn't feel the ci±y <br />could enforce Section 110.143 of the City Code regarding weeds and grass <br />because it is impossible to stay on top of these type of complaints and <br />the citizens are just not going to maintain huge lots like they do in Anoka. <br />Therefore, he is requesting that the City Council review the matter with the <br />intent to delete Section 110.143 of the City Code. <br /> <br />After much discussion, it was the concensus of the council to leave <br />Section 110.143 regarding weeds and grass in the City Code in case the <br />city would need it in the future. <br /> <br />North Central Public Service RegardingjGas Rat.es <br /> <br />The council noted the proposed gas rates that may be coming from North <br />Central Public Service l~er this year after the Public Service Commission <br />finishes their review. <br /> <br />c/August 26, 19S0 <br /> Page 12 <br /> <br /> <br />
