429 Special Assessment Procedure for New Plats

Mayor Gamec said he was against going into this right now because
without city water and sewer available and with the amount of staff
and legal work that goes into it, it would not be feasible at this
early time.

Councilman Sorteberg that it will help the one
end money.

who doesn't have front

Councilman Cox said if a person had front end money, maybe that would
open up areas of development.

Motion by Councilman Cox and seconded by Councilman Mickelson to
adopt Resolution #80- 1i8 authorizing City Staff to draft the
appropriate ordinance language, including all necessary safeguards, in
order 'to implement a City policy whereby the required City plat
improvements for commercial and industrial areas are constructed and
financed pursuant to Minnesota Statutes Chapter 429.

Motion carried. Voting yes-Mayor Gamec, Councilmen Sorteberg, Reimann,
Mickelson and Cox. Voting no-None. Refer to resolution file for Resolution #80-118

~_Q ~r~q~ding~_h~Pter 210.01 Street Assessment Procedure

Discussion was held on the proposed Ordinance #80-8 Amendment to
Chapter 210.01 which is known as the "Street Assessment" Chapter of
the City Code.

City Attorney Goodrich said the sentence which reads, "No general funds
shall be used for upgrading city streets." was deleted.

Councilman Sorteberg asked if the council could define the "collector"
streets.

Councilman Cox said no because they could change.

City Attorney Goodrich recommended adding a paragraph about "collector"
streets that they may or may not be assessed as determined by City
Council.

Councilman Mickelson felt they should be assessed right now. Maybe in
the future when all the streets are blacktopped and there is a
maintenance issue, it could be changed.

City Attorney Goodrich was asked to re~ite the ordinance and put
in the changes discussed at the meeting.

~age Ditch (County Ditch. #43) Regarding Flintwood II

City Engineer Raatikka reported that the developer went to the County
and asked for a realignment and found out that the Legislature passed
a law that they could abandon ditches. The developer wants city 'input
on this decision to abandon and relocate the ditch. He said the developer
is willing to put in a lateral system which would provide a leg for the
County Ditch. They recommended a 5~" pipe and it would have to be assessed out.

C/September 23, 1980
Page 7
