Much discussion followed on the proposed amendment. <br /> <br />Councilman Sorteberg suggested tabling this issue to give the council members <br />;~re time to do more research on it. <br /> <br />Motion by Councilman Cox and seconded by Councilman Mickelson to table <br />approval of Amendment to Section 170.038C Paragraph (7) of Chapter 170.03 <br />of the City Code until the Regular Council Meeting of November 11, 1980. <br /> <br />Motion carried. Voting yes-Councilmen Reimann, Sorteberg, Mickelson and Cox. <br />Voting no-None. <br /> <br />3) Request for Variance from the City Subdivision Code 170.03 to Build a <br /> <br />Second }~ouse on a 10-Acre Parcel of Land; Case of Mr. Raymond Mox <br /> <br />An attorney was present represent',mng the Mox's. The attorney said somewhere <br />along the line there was a misunderstanding of what the Mox's actually wanted. <br />They want to keep their ten acres on the farm and in the family. When they <br />applied for a building permit, they were tod that they needed a sumvey and <br />they decided it was too expensive to do a survey. They' are not asking for <br />a variance, but a waive~on the survey. <br /> <br />City Administrator Schnelle said they have one house on a 10-acre parcel now. <br />The City has never run into this situation before where the City has allowed <br />another house on a parcel that already has one. <br /> <br />City Attorney Goodrich said the City can't require a Pamk fee. if there is no <br />subdivision. <br /> <br />The Mox's attorney said that the Mox's understand if they want to sell either <br />house or both that they will have to comply with all the requirements. <br /> <br />Mr. Mox said there will be no mortgage on this. <br /> <br />Councilman Reimann asked if they would have any objections to where the house <br />would face as the City wants to limit accesses onto the thoroughfares. <br /> <br />The Mox's attorney said there is no intention at this time to subdivide the <br />property. He recommended to the Mox's that they work with the City as far as <br />location of the house. <br /> <br />Councilman Reimann said the City is trying to save them problem in the future. <br /> <br />City Attorney Goodrich said the council may want to make a policy in the future <br />that states there should be only one house per lot of record. <br /> <br />Councilman Sorteberg noted that this is a very unusual case being there is no <br />mortgage involved. <br /> <br />City Attorney Goodrich was instructed to prepared a contract and findings of <br />fact for the regular council meeting of October 14, 1980. <br /> <br />The council meeting recessed at 9:20 p.m. <br /> <br />Special Council <br />September 30, 1980 <br /> Page 4 <br /> <br /> <br />
