Mr. Reinke further stated that no trucks <br />will leave the area until after 8:00 ^.M, and will return before <br />dark. Ite also stated that it is not uncommon for the trucks to <br />be out of the area for days at a time. <br /> <br />Mayor Gamec stated that Council has review Planning and Zoning <br />minutes regarding this case. <br /> <br />Mr. Reinke stated that two days after the Planning and Zoning <br />pub].~c hearing, one of his neighbors held a boutique and at <br />one time there were 15 cars parked in the street, and that <br />City Staff could verify this statement. <br /> <br />Counc~lmember Sorteberg stated that P & Z performed a very thorough <br />e×~mination of this case and that he can go along with a temporary <br />permJ, t. <br /> <br />Mr. Goodrich stated that any deviation from the proposed agreement <br />shall be cause to automatically revoke the conditional use permit. <br /> <br />Councilmember Cox stated that he review P & Z comments and one <br />fact that is overlooked is that the City zones R~I to protect <br />private homeowner and the City zones Commercial to generate tax <br />base. Then, at the same time, the City works against those <br />businesses operating within commercial laws by allowing businesses <br />to operate in a residential area and if that is going to be the <br />case, commercial areas should be taxed the same as residential <br />areas. Councilmember Cox also stated that if Mr. Reinke can <br />afford an attorney to attend two meetings in his behalf, then <br />he can probably afford to rent commercial space. <br /> <br />Councilmember Reimann stated that Mr. Cox's comments are well <br />taken. <br /> <br />Councilmember Cox stated that the citizens have submitted a <br />petition in objection and Council should honor that petition and <br />disapprove of Mr. Reinke's request. <br /> <br />Mayor Gamec stated that a petition is not basis for denial. <br /> <br />Mr. Phi. laja stated that he has represented Mr. Reinke ih the <br />past and now that his business is going bad, he is donating <br />his time in Mr. Reinke's behalf. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember <br />Van Wagner to adopt the findings of fact as presented by the <br />Planning and Zoning Commission regarding Mr. Ed Reinke's request <br />for a temporary conditional use permit in an R-a area. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cox, <br />Sorteberg, Reimann and Van I~agner. Voting No: None. <br /> <br />Motion by Councilmember Cox and seconded by Councilmember Reimann <br />to disapprove of granting Mr. Ed Reinke of 8059 154th Avenue NW <br />a temporary conditional use permit to store snow plowing equipment <br /> <br />C/November 23 <br /> Page 9 of 21 <br /> <br />~982 <br /> <br /> <br />
