I <br />I <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />i <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> PROPOSED <br /> FINDINGS OF FACT <br /> <br />HOME OCCUPATION PERMIT <br /> BEAUTY SHOP <br /> <br />1) That the Applicant has properly applied for a conditional use permit as required <br />by Ordinance to operate and maintain a beauty shop. <br /> <br />2) That the Applicant appeared before the City Planning and Zoning Commission for <br />a public hearing pursuant to the City Zoning Ordinance on December 7, 1982 and that <br />said public hearing minutes are hereby incoporated as a part of these findings by <br />reference. <br /> <br />3) That said public hearing was properly advertised in the CitY's official newspaper <br />and that adjoining property owners were notified of said public hearing in accordance <br />with City Ordinance. <br /> <br />4) That the Standards for Consideration are as follows: <br /> <br />a) Tha property is zoned R-1 and this is not a permitted use. <br /> <br />b) The adjoining properties are residential dwellings located on approxi- <br /> mately one acre parcels. <br /> <br />c) The. closest simlilar use is within a distance of approXimatbily<one nii.le. <br /> <br />d) There will be no adverse effect to traffic flow in the area. <br /> <br />e) There are several known beauty shops in operation within the City which <br /> to our knowledge have not caused neighborhood problems. <br /> <br />f) <br /> <br />Properly maintained, the beauty shop will not affect the life style of <br />the neighboring residents in a residential setting. Further, it should <br />not affect the enjoyment or value of properties in the vicinity. <br /> <br />5) That the Criteria for Approval are as follows: <br /> <br />a) <br /> <br />The operation of a beauty shop should not be detrimental to or endanger <br />the public health, safety or general welfare and is not contrary to <br />established standards as regulated by City Code. <br /> <br />b) <br /> <br />The lot size and proposed beauty shop location should not be unsitely <br />or undesirable or obnoxious in appearance and should not hinder the <br />orderly and harmonious development of the City or the district where <br />herein proposed. <br /> <br />c) An inspection of the premises showed adequate water supply and sewage <br /> disposal facilities. <br /> <br />d) The use will conform to the regulations of R-1 zoning except that a <br /> conditional use permit is required. <br /> <br />6) That the Performance Standards are as follows: <br /> <br /> <br />
