NOTE COUNCIL MINUTES <br /> <br />Commission noted the following: <br /> <br />1) Special Council meeting minutes dated'December 6, 1982 regarding the <br /> Landfill. <br /> <br />I <br />I <br /> <br /> I <br />I <br /> I <br /> I <br /> <br /> I <br /> I <br /> <br />2) Regular Council meeting minutes dated December 21, 1982. <br /> <br />Commissioner Deemer, referring to Council minutes dated December 21, 1982, <br />Council Old Businesss, Case #8, inquired why Mr. Delano Skeim's request for <br />Urban Development Permit was included in the agenda after Planning and Zoning <br />tabled the matter for lack of information. <br /> <br />Mr. Berg replied that it was Mr. Schnelle's decision to place the matter on <br />the agenda. <br /> <br />Commissioner Deemer stated that the Planning Commission should take a stand <br />on this issue and request proof that all platting requirements have been <br />accomplished. Commissioner Deemer further stated that too many issues are <br />being approved "Contingent Upon" and the contingencies are not being accomplished. <br /> <br />Commissioner Dunn stated that the 'subject motion is "to approve providing the <br />following has been accomplished". Commissioner Dunn further stated that the <br />City does have a Building Inspec~0r, Attorney and Engineer whose purpose it is <br />to see that all ordinances and codes are complied with. The subject approval <br />is contingent upon meeting platting requirements, and if they are not met, <br />there is no development agreement. <br /> <br />Mr. Raatikka stated that the final plat has been approVed, but not signed as <br />of yet. <br /> <br />Chairman Peterson stated that the minutes should reflect that Mr. Deemer <br />would like to review Mr. Del Skeim's final plat. <br /> <br />COMMISSION BUSINESS <br /> <br />Case #1: Request For Variance From The Subdivision Ordinance; Case Of Mr. <br /> <br />Harold Phelps: <br /> <br />I <br />I <br />I <br /> <br />Mr. and Mrs. Harold Phelps were presented and are requesting'a variance to <br />Section 170.0314B of the Zoning Ordinance which requires that a parcel of <br />land abut a City street to qualify as a buildable site. <br /> <br />He has entered into a purchase agreement for a 30 acre parcel just north of <br />the Trott Brook and west of the Rum River. He has acquired access by means <br />of an easement across a 40 acre parcel adjacent to the ~orth of his property, <br />which 40 acre parcel fronts on a portion of 177th Avenue NW in the Riverwood <br />Hills Addition. <br /> <br />The Planning Commission then reviewed the Findings of Fact included in the <br />agenda. <br /> <br />Mr. Berg stated that this situation should be no problem to the City as long <br />as Mr. Phelps is aware that the City will assume no responsibility for road <br />maintenance as it would be a private driveway on his easement2 <br /> <br />P & Z/January 4, 1983 <br /> Page 2 of 5 <br /> <br /> <br />
