Absent: Commissioner Dunn. <br /> <br />Planning and Zoning Commission then reviewed the proposed Conditional Use <br />Permit Agreement. <br /> <br />Mr. Terry O'connell - Group W - Stated that Group W will provide for fencing <br />if the City requires them to do so. <br /> <br />Commissioner Deemer stated that.if the City requires fencing, the courts could <br />interpret that as the City assuming responsibility for safety hazards and the <br />City could he held liable in the event of an accident CommisSioner Deemer <br />further commented that the City should not require fencing, that Group W <br />should be responsible for safety features~ <br /> <br />Commissioner Schneider suggested that wording be included in the proposed <br />agreement to the effect that Group W provide what they feel is necessary as <br />far as safety is concerned and she added that if a child is curious enough' <br />to try and climb the tower,, a 6' fence will not prevent that child from doing <br /> <br />SO, <br /> <br />Commissioner LaDue stated that it would not be negligent not to provide for <br />fencing considering the tower ~s located on private property. <br /> <br />Commissioner Isakson inquired if blinking lights would be required on the <br />tower. <br /> <br />Mr. O~Connell replied that blinking lights would not be required. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to recommend <br />Ramsey City Council enter into a Conditional Use Permit Agreement with Group <br />W. Cable T.V. based on the Findings of Fact and the Conditional-Use Permit <br />Agreement amended as follows: <br /> <br />Item #4: - Should read as follows: "That the Permittee shall construct <br />the building of materials which are compatible to other structures <br />in the neighborhood. <br /> <br />Further, that the City grant a variance to the height ordinance for Group <br />W. Cable T.V. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners LaDue, Schneider, <br />Isakson, Deemer and Zimmerman. Voting No: None.
