Chairman Heitman noted that laws of State and Federal Government take priority over Charter rules and anything a Charter does is supplemental or in addition to State and Federal laws. He further commented that Ramsey's current type of government is function but lacks input from public. Commissioner Gamec inquired if Charter makes the difference or gives the opportunity? Commissioner Buchanan replied that Charter gives the opportunity to make a difference. Commissioner Buchanan stated that the only way to control a conflict of interest between Urban area and Rural area is through a Charter. I I Motion by Commissioner Buchanan and seconded by Commissioner Bauerkemper that as a Commission, it has been decided that a Charter for Ramsey is necessary and to proceed with the writing of that Charter. Further Discussion: Chairman Heitman inquired if it is wise to make such a decision prior to any research. I I I I I I I I I I Commissioner Buchanan withdraws his motion. Commissioner Data suggested inviting persons from other communities that are Charter or recently adopted Charters, to provide input to Ramsey's Charter Commission. Commissioner Buchanan suggested caution should be taken to obtain an even view of old and new Charter cities. Commissioner Buchanan stated that a key item to be looked at in terms of Charter is to make it functional. Commissioner Buchanan stated input with regards to writing a Charter or not should be provided at the next Commission meeting and.a decision made at that time. Commissioner Lichter stated that the petition seems t9 say that most people are in favor of a Charter being written and presented for~a vote. Writing a Charter doesn't mean the City will go Charter, the petition was to write a Charter and let the people decide if they want a Charter. Commissioner Data stated that a broad view regarding Charter versus Statutory is needed in order to make a decision whether or not to proceed with the writing of a Charter. Chairman Heitman stated that Charter allows for initiative of referendum, which allows people to change what they want and not wait 4 years to make those changes. Commissioner Lichter stated that Charter is a way to streamline processes in the City. Commissioner Gamec stated that only elected bodies can authorize spending of money, therefore to streamline the process,boards such as the Park Board, would have to be elected. Commissioner Lichter replied that various boards could be authorized to spend but that Council would retain the right to veto. Motion by Commissioner Buchanan that the next meeting of the Ramsey Charter Commission be devoted to receiving input regarding Charter versus Statutory, to include persons from existing Charter cities and public input, and that the Commission examine pros and cons presented and make a decision as to CC/June 2, 1983 Page 6 of 10
