Section 170. 013D (5) <br /> <br />States that in the Residential District on unsewered <br />lots that the river setback shall be: <br /> <br />"35 feet from the bluff line or 200 feet from the <br /> <br />normal high water mark whichever is greater" <br /> <br />Minimum sized lot will be 2.5 acres, and <br />Minimum lot width shall be 200.0 feet. <br /> <br />These lot provisions are of real concern to us, be- <br />cause of the acreage lying to the east (right) of Tract B, <br />R. L.S. #53 (along the river) and south of 139th Lane. <br />Tract "B" was sold in the early 1960's with its legal <br />access over the roadway identified as 139th Lane. <br /> <br />This acreage (south of 139th) is around 3.5 acres with <br />frontage of approximately 575.0 feet. According to the <br />proposed regulations, this acreage could be developed <br />to no more than one lot. Also because of its shallow <br />shape, the 200.0 foot required Setback would make <br />house placement on this site very difficult. <br /> <br />! have been assured in my previous meetings with this <br />Board and the City Council'that a variance would be <br />worked out for us for this tract, yet there' is no provi- <br />sion for a variance for hardship in this ordinance. <br /> <br />We believe that this tract whose boundaries were es.-, <br />tablished prior to the Critical Rivers legislation,a~e <br />treated much as a dwelling already built too Close to <br />the river. We ask that we be allowed to develop two <br />unsewered lots on this tract and be allowed to locate <br />the houses closer than ZOO. 0 feet to the river. <br /> <br />Thank you for your patience with our concerns. <br /> <br /> truly yours, <br /> <br />mes M.
